Held, claim not submitted within the 6-month claims period required for governmental entities.?Attorneys telling the Plaintiff that it was a 1 year not six month SOL did not constitute mistake, inadvertence, surprise, or excusable neglect. Plaintiff’s probation violation was reversed on a finding of ineffective assistance of counsel. The ineffective assistance of counsel was August 2020. The IAC habeas petition was granted June 2022. ?He had been wrongfully imprisoned for 600 days.?June 2023 Plaintiff submitted claim to the County. TIDBIT TUESDAY! Anatomy of a Law Suit By Shelene Giles, CEO, Educator, Mentor Tort law is a civil law, and it includes negligence, personal injury, and medical malpractice claims. Tort law will include cases of injuries or illnesses as a result of negligence, a personal injury or a medical malpractice claim. Tort law is a breach of duty or wrongful act, which results in injury to person or property. In tort law, attorneys must prove a burden of proof. You hear the term “beyond the shadow of a doubt”, that is criminal law. That is different from civil law. In tort law, the attorneys must establish “the burden of proof”. Attorneys will use the term “preponderance of evidence”. So when you watch CSI, Law and Order or you sit in a courtroom you will hear the jury being instructed that the goal here is to determine the burden of proof based on the preponderance of evidence. That means greater than 50%. In criminal law, “Beyond a shadow of a doubt” means the jury is 99.99% positive the person or business committed wrongdoing. In tort law, the attorney only has to prove 50.1% negligence or somebody else’s fault. Or they defend their client and prove that less than 49.9% they were not at fault. Tort law can also involve causation and damages. Who caused it and what are the damages from that? Damages come in many different forms. Life Care Planners are medical damages experts. Damages can be in the form of liability and damages can be in the form of medical. Liability is damage to the property, such as damage to the car or damage to a building.
