It's not just about the report in litigation outcomes--if you're referring to trial. From the experience I had earlier this month with jury duty, I read two expert reports, one from each side. Both reports were well written and included support from references. It was the testimony of the experts that caused the jury to vote the way they did. One expert had a 6-pg. report and was an accomplished testifying witness. The other report was 13 pg., referenced standards of care throughout and focused on an additional phase of the defendant's health history. However, this expert was not as polished when giving testimony and the jury perceived this as being forced, which I believe, was more due to nerves than not standing behind the content of the report.
