We have rights in theory. We are people living with no rights in practice. Humanity and personhood are not earnt or attributed by virtue. No one deserves rights. Personhood is not a merit system determined by the powerful and privileged. Human Rights are denied by the free will and choices of people in positions of power and the abuse of that power. Not recognising the power you have and the consequence of your use of that power is an abuse of power. We are denied humanity, liberty and dignity by people who don't practice humanity or responsibility and the systems that incentivise people to act inhumanely towards others without concience or reprocussions. Rights can be denied and people oppressed by those who act within their power and capacity without responsibility. This is the abuse of power and freedom. These are the people who's freedom needs to be curtailed with respect to their lack of responsibility towards others. lack of understanding of the obligations associated with freedom and privilege is not a justification or excuse. Just like a criminal act of harming another does not absolve criminality or responsibility because the harm was not considered or understood by the perpetrator of harm. A lack of intent is a lack of understanding the responsibility of freedom. Your ignorance does not avoid or negate harm. It creates it. Nor does it absolve you of responsibility for the consequences of your actions. Oppression is created. Disadvantage is created. Human Rights can only be denied through abuse of power.

Yes and many articles and even the Publlic Service of Canada inclusion guidance identifies that remote reporting removes barriers enabling individuals with disabilities the 'right to work'. Yet in our zeal to force people back to offices post pandemic we also want to recreate old barriers that had prevented persons with disabilities from participating. I have no issue with employers stating preferences. I just desire that they also respect the rights of persons with disabilities and desire to accommodate without creating onerous processes to discourage people with disabilities for asking for what removes barriers or create approval processes that increase errors time and likelihood of refusal. We can achieve a post COVID normal that embraces new realities that include embracing remote reporting to reduce barriers to ensure all have the right to work.

As South Africa prepares to celebrate Human Rights' Day tomorrow, it is important to recognise that "Human Rights for only some, are Human Rights for none." This. Once more thanks to Puneet Singh Singhal for highlighting this and keeping the conversation alive and at the forefront. We shouldn’t have to jump through government imposed hoops to get access to sign language interpreters. The human rights act gives us the right to equal access to information and the Disability legislation states it’s unlawful to intentionally or unintentionally discriminate against those with disability… yet only yesterday I was told I had to do a lot of hoop jumping in order to gain funding for a one hour session with a life coach which would be beneficial to many in the long term. I was denied said access to my own language of NZSL citing rules (hoops) and lack of funding. I want to ask how much value does the current NZ government, Louise Upston, place on each Deaf community members heads? By default we only get granted $5k per year for job supported interpreting services (been this way for many many years) It costs on average $100 -150 an hour for an interpreter with a minimum of an hour booking. You have to jump through many hoops to prove that the need is higher. I have done this previously and it took a long time right down to the smallest detail required. This is wrong for a group of society to still be treated as un human and fighting for our basic human right to access information in the form we understand. I’ve been denied access to interpter by doctors in hospitals, and healthcare as a result and even a physical injury, had to spend hours and hours on relay calls to get ACC assist and to ask for a face to face meeting with interpreter assist, ignored and treated very poorly by GP practices, told to go use advocacy services to “complain” and yet they themselves refuse to work with Deaf people citing they don’t do calls to NZ relay and then wouldn’t engage either by face to face at a community law office where it could be interpreter assisted. Had a relay call with the Disabilty and Health commission once and they never got back to me. I chased it up and got the same response that they don’t do relay calls. Even those within the legal system and legal government department don’t have the skills to assist us and refuse to. NZ government departments who should know how to work with all communities don’t get trained or taught how to first show respect to Deaf members and secondly know how to provide access to sign language. Putting it bluntly: this makes them in breech of NZ legislation. These are real life lived experiences happening this year alone. The even sadder part is I’m having conversations within our global community networks that it’s not only our government that needs to take note of what really is happening on the front line.
