Competent defense investigators are critical to success, but not everyone has access or funding. We can do it on our own if necessary. I love to hit the streets and talk to the people invovled in cases. My rule of thumb is interview every witness at least once, even if they seem inconsequential. I like to visit the crime scene a few times too (on different days and at different times). We need to turn the tables and know the case better than the original investigators. I abhor the old saying "you can’t change the facts." Yes you can, by discovering ALL the facts! This post by Justin Vincent is a clear blueprint for effective investigation.

As defense investigators, it’s our job to uncover the facts that others miss—facts that can turn the tide in a case and ensure justice prevails. Here are some key strategies I’ve found invaluable in uncovering those missing pieces: Revisit the Scene with Fresh Eyes: Crime scenes hold more than evidence; they hold context. Revisiting the scene allows us to notice details that may have been overlooked initially—sightlines, lighting conditions, or environmental factors that challenge the prosecution’s narrative. Re-interview Witnesses: Witness accounts evolve over time, and often, they remember—or reveal—new details when approached in a neutral, non-confrontational way. A second interview can uncover inconsistencies, biases, or even entirely new leads. Follow the Digital Breadcrumbs: In today’s world, digital evidence is everywhere—cell phones, GPS data, surveillance cameras, and social media. A methodical review of these sources often reveals crucial timelines, alibis, or discrepancies that can shift a case’s direction. Challenge Assumptions: The prosecution often builds a case based on initial assumptions that go unchallenged. Our job is to question everything. Does the evidence truly support their theory, or does it point elsewhere? This mindset leads to creative approaches and unexpected discoveries. Focus on Human Connections: People make mistakes. Police officers, witnesses, even the accused—everyone has their blind spots. By understanding the human element in every case, we can identify motives, errors, and misunderstandings that others may miss. Dive into Records: Medical records, financial statements, phone logs, and other documents can tell stories no one expected. The key is knowing where to look and how to piece together a timeline that challenges the prosecution’s narrative. Work as a Team: No case is solved in isolation. Collaborating with defense attorneys, experts, and consultants ensures every angle is covered and no detail is overlooked. A strong defense team is a united one. Finding the facts that others miss is more than a skill—it’s an art, grounded in persistence, creativity, and a commitment to justice. In criminal defense, playing defense is essential, but sometimes the best defense requires going on the offensive. To do that I meet with my clients early and I meet with them often. This is what I tell them about how they can assist: ? Provide All Information: As soon as possible, share everything you know about your case. This includes the events leading up to your arrest, what happened during your encounter with law enforcement, and any details that might be relevant. Even small pieces of information can make a significant difference. ? Witness Statements: If you know of any witnesses who can support your version of events, provide us with their contact information. We will work to obtain statements from them as part of our defense investigation. ? Surveillance Footage: If there is any security or surveillance footage from the location of the incident, let us know right away. Video evidence can be critical in proving your innocence or showing that the prosecution’s version of events is inaccurate. The sooner we can secure this footage, the better. ? Evidence You May Have: If you have any documents, emails, text messages, or other forms of communication that could help your case, provide them to us immediately. This can include anything that shows your whereabouts, your actions, or your intentions leading up to the incident. ? Timeline of Events: Write down a detailed timeline of the events surrounding your case. This will help us better understand the context and identify potential areas to explore in your defense. ? Stay in Communication: Keep the lines of communication open. If you come across any new information, witnesses, or evidence, notify us as soon as possible. This will allow us to quickly evaluate its potential impact on your case. By actively participating and providing as much information as possible, clients can help us build the most robust defense strategy to protect their rights and fight for their freedom.
