On July 15, 2024, Environment and Climate Change Canada announced new efforts to tackle per- and polyfluoroalkyl substances (PFAS), also known as "forever chemicals." These persistent human-made substances are found in many everyday products and have significant environmental and health impacts. Key Measures: - Updated PFAS Report: The Government published a Draft State of PFAS Report and a revised Risk Management Scope, concluding that most PFAS are harmful to human health and the environment. - Fluoropolymer Assessment: A separate assessment for fluoropolymers, potentially adding them to the CEPA Watch List. - Phased Approach: Starting with regulations to restrict PFAS in firefighting foams, followed by additional measures for other uses. Public Consultation: Stakeholders are invited to comment on the update until September 11, 2024. Canada remains committed to addressing the risks of PFAS and is among the first jurisdictions to tackle these chemicals comprehensively. The Government will continue using a science-based approach to protect the health of Canadians and the environment. Deadline alert! ?? PFAS reporting in Canada is due in only a few weeks. In 2024, Environment and Climate Change Canada (ECCC) released a Notice under Section 71 of the Canadian Environmental Protection Act (CEPA), requiring businesses to submit data on per- and polyfluoroalkyl substances (PFAS) for the 2023 calendar year by January 29, 2025. ?? Now, what is PFAS reporting all about?? PFAS are synthetic organic compounds that do not naturally occur in the environment. Due to their strong fluorine-carbon bond, these "forever chemicals" do not degrade and can accumulate, causing harm. Therefore, reporting PFAS data is not only crucial for compliance with the CEPA – it also helps protect the environment and public health. ???? By submitting this data, you assist in regulatory efforts to assess and manage associated risks. Unsure if your company is obligated to report or what data needs to be reported? ???? The Environment and Climate Change Canada (ECCC) has issued a significant proposal to track the release of 131 PFAS under the National Pollutant Release Inventory (NPRI) for the first time. This move aims to provide data on PFAS emissions, helping to shape future risk management actions and guide pollution prevention efforts under the Canadian Environmental Protection Act (CEPA). The consultation has been open to public since September 26, 2024 and will close to new input on November 25, 2024; it targets stakeholders from industry associations, environmental non-government organizations, and indigenous organizations as well as members of the public. Don’t miss a chance to have your say by requesting the full consultation to NPRI. At Lisam, we are committed to keeping our clients updated on critical regulatory developments, ensuring they remain compliant and ahead of emerging chemical regulations. ?? With a January deadline fast approaching, businesses must familiarize themselves with Environment and Climate Change Canada's Per- and polyfluoroalkyl substances (PFAS) reporting requirements to ensure compliance and mitigate the risk of environmental enforcement legal action and penalties. Nathan Adams and Michael Hebert explain how PFAS are under increased regulatory scrutiny in Canada due to their potential environmental and health risks.

Here’s a useful primer on the current state of play for PFAS policy in Israel, kindly compiled by Danniel Sharon from the Ministry of Environmental Protection. On 11 December 2024, this was presented at the OECD Environment webinar sharing global updates on PFAS risk management, highlighting Israel’s proactive efforts: 1?? Drinking Water Contamination: PFAS was detected in 21% of sampled drinking water wells, with six already closed due to exceeding thresholds. By 2026, stricter thresholds are expected to impact more wells. 2?? Industrial and Wastewater Sources: PFAS contamination was found in 85% of industrial wastewater samples, 80% of landfill leachates, and 50% of stream samples. 3?? Regulatory Actions: Israel is focusing on mapping contamination hotspots, identifying AFFF as a major source, and implementing an action plan to address PFAS in industrial sources and waste streams. For a global perspective, check out my other posts on the EU’s comprehensive regulatory framework and Japan’s science-driven initiatives, also presented during the webinar. #PFAS #Israel #ChemicalPolicy #EnvironmentalProtection

Did you cross paths with members of the #PFAS family? If your organization meets the federal government’s criteria for reporting perfluoroalkyl and polyfluoroalkyl substances, Environment and Climate Change Canada wants to hear from you. While various regulations restrict and control the use of certain PFAS variants, the federal government introduced a one-time reporting requirement with a view to potentially mapping out regulation down the road. Under Section 71 of the?Canadian Environmental Protection Act, businesses and other organizations must — with some exceptions — report the manufacture, sale, offer for sale, import, and use in 2023 of 312 specified PFAS variants. The reporting deadline is January 29, 2025 and Environment Canada spokesperson Josh Brighton describes it as a one-time event aimed at cataloguing the general presence of PFAS rather than measuring specific volumes. “This initiative is to gather baseline data to support future decision making, therefore it is not a recurrent initiative that will carry on in future years,” says Brighton. #environment #regulation #law Actual Media Inc. https://lnkd.in/ggVPHdtV

On October 2, the Government of Canada announced new initiatives aimed at strengthening environmental protections and ensuring the right to a healthy environment for all Canadians. Ministers Steven Guilbeault (Environment and Climate Change) and Mark Holland (Health) introduced a framework under the Canadian Environmental Protection Act, 1999 (CEPA), targeting harmful substances and enhancing chemical management. Key Highlights or Key Points: - A Draft Implementation Framework on the Right to a Healthy Environment will guide the administration of CEPA, 1999, ensuring environmental justice and the integration of Indigenous knowledge. - A proposed Watch List will monitor substances with hazardous properties that are not yet classified as toxic. - A Plan of Priorities outlines how the government will address chemical substances in Canada moving forward. - A Draft Strategy seeks to replace, reduce, or refine vertebrate animal testing in chemical assessments. - The updated Draft State of PFAS Report concludes that PFAS, excluding fluoropolymers, poses risks to both the environment and human health. The public will have the opportunity to provide feedback on these initiatives starting October 5, 2024, with a focus on ensuring robust environmental protections.
