The concept of “code is law” suggests that smart contracts execute exactly as they are written, without human interference, unexpected outcomes, or errors. Some argue that this idea could potentially lay the groundwork for a #Web3 legal system. At first glance, this approach may seem appealing due to its promise of automation and trustlessness. However, upon closer inspection, the concept is incomplete. Traditional legal systems are built on principles of equity, justice, and intent, which often require interpretation or the ability to override the strict terms of a contract. A good example, as highlighted by Sergey Ostrovskiy, is when a #blockchain smart contract design flaw allows a bad actor to misappropriate funds. While the code may execute as intended, such an act would likely be considered a crime under traditional legal systems, where intent and fairness are taken into account.
