The UK's Digital Markets, Competition and Consumers Act (DMCCA) is set to come into force in October 2024. This new legislation grants the Competition and Markets Authority (CMA) significant powers to regulate and supervise the power of 'Big Tech.’ It introduces a new regime for digital markets, designating certain tech companies as having 'strategic market status' (SMS). SMS companies will be subject to a bespoke code of conduct, pro-competitive interventions, and merger reporting obligations. Companies may need to adapt their compliance procedures and ensure appropriate responses to CMA requests for information. The European Commission's decision on the Orange-MásMóvil joint venture, announced yesterday, is a challenge for the Spanish telecoms sector. The European Commission has missed a great opportunity to adopt a pro-investment approach that could contribute to the challenge of Spain's competitiveness. Once again, European competition policy and European industrial policy seem misaligned. It is time to reflect on whether EU merger rules are still fit for purpose. Telefónica's advocacy in recent years has focused, among other things, on promoting consolidation in national telecom markets. The European Commission recognises that the financial situation of operators in the EU electronic communications sector raises uncertainties as to whether operators will achieve the investments needed to catch up with technological change and future needs. Delays in this respect represent a huge vulnerability for the European economy as a whole. Operators need national market structures that ensure sufficient profitability and thus encourage investment. The European Commission's focus on creating artificial competition in telecom markets is not compatible with the competitiveness goals of the European economy and the objectives of the Digital Decade. By imposing conditions for the approval of the Orange/MásMóvil deal, the Commission has prioritised regulatory intervention over the laws of free competition in a well-functioning market and has missed a major opportunity to promote an investment-friendly market structure for telecoms operators in Spain.
