The City of La Crosse has recently updated their Comprehensive Plan and is seeking proposals from qualified consulting firms to update their subdivision and zoning municipal codes. The Request for Proposals has been?issued by the City of La Crosse Planning, Development, and Assessment Department. The RFP contains information and guidelines for submittal along with the City’s Standard Contract Terms and Conditions. The RFP provides the information needed for you to determine your interest in the project and assures an equitable process. Please make sure you read through all documents thoroughly before submitting your proposal. Proposals must be submitted digitally to the City of La Crosse Planning, Development, and Assessment Department no later than 4:00 P.M.CDT on Monday, September 16, 2024. Last week our team attended the Urban Planning Committee to discuss construction site safety and accountability in City of Edmonton. Most construction is carried out responsibly, but we take our responsibility to protect the public very seriously, and know that our rapidly growing city requires innovation in the regulatory space to ensure success. We introduced two new tools, one which will help set up our building industry for success, and the other to hold negligent constructors accountable when necessary. The mandatory Project Implementation Plan (PIP) will be a condition of permit issuance, and ensure every constructor has a plan to minimize the risks associated with construction. The Construction Accountability Program (CAP) will track builders, owners, and contractors, creating a compliance record. If a threshold of non compliance is reached the responsible parties will be required to attend builder education sessions at their own expense, and may even loose the right to build in our city permanently if they fail to improve to an acceptable standard. These new programs were robustly supported by the Urban Planning Committee, along with industry and community groups such as BILD Alberta Association and Edmonton Federation of Community Leagues (EFCL) and will be fully implemented in 2025. We are proud to highlight the work of Alex Barrett, Corporate Real Estate Manager, at The Heritage Group. Alex wrote the following regarding what public administration concepts have translated to his current career: "I believe I've had two large takeaways from the program that have helped me professionally. The first, I developed a better understanding of the way government works at the administrative agency level. In my previous, and current, jobs I deal a lot with local and state government agencies (IDEM, USACE, Zoning Boards, IURC, IEDC, Etc.). Better understanding how these agencies work and relate to each other and the general public has helped expand my ability to work with them. I can provide some pretty specific examples on this if you'd like but most will center around coordination with local governments on zoning issues related to our infrastructure construction company and navigating those (sometimes) rough terrains, or they will center around creative ways we work with IDEM/USACE on resolving wetland/WOTUS issues." "The second biggest takeaway I had with the #MPA program was data analysis. This hasn't been something I've consistently used, but when I have issues arise that require analysis of data and what it means, it's nice to have the experience I gained in the program in my back pocket." In regard to the most valuable or memorable information he took from the program, Alex cited "the general understanding of public agency structure and a more detailed look at how they function." #publicadministration #policy

Although we should point out, that this Appeal could have been avoided if the LPA had given weight to our argument concerning the status of Neighbourhood Plan policies when considered against the Local Plan. APL'S Denise Knipe supported the Architect with a resubmission application for a single dwelling on the edge of a village.?There was conflict between the Neighbourhood Plan and the Local Plan where windfall development was concerned and strategic polices.?Section 38 (5) of the Planning and Compulsory Purchase Act (2004) states that if to any extent a policy contained in a development plan for an area conflicts with another policy in the development plan, the conflict must be resolved in favour of the policy which is contained in the last document to become part of the development plan. In this case, the Local Plan was adopted after the Neighbourhood Plan, and on this basis the local plan policy must take precedence.?The NPPF at paras 29 and 30 add further weight to this position. ? Despite presenting this argument for the application the Council refused the outline application citing conflict with the Neighbourhood Plan.?We submitted the Appeal and although its taken 10 months the Inspector has allowed the Appeal endorsing section 38 (5). #justsaying #planningappeal #townplanners #planningsuccess #success #planningapplications #collabortation #architects

A true story. It is about clearing a site before planning approval is issued. It happened in the eastern suburbs, City Of Monash. A dual occupancy proposal. Council refused, our client appealed at VCAT. In the time between the council refusal and the tribunal hearing, the site was cleared and new boundary fences erected. New fences were higher, casted greater shadow to the neighbours, updated overshadowing analysis diagrams were prepared based on the additional shadow. In the tribunal hearing, Council argued the assessment should be based on the old fence heights that were in place at the time the application was made. We argued the analysis should be based on the newly built fence heights on the basis that planning permission was not required to replace the fences and it would be futile to rely on former conditions that no longer exist to make a decision. The tribunal concurred with Councils approach. However, they disagreed with council about the acceptability of the additional overshadowing and overturned the refusal. ?? ?? Key takeaway – decision makers can consider site conditions at the time the application is made, even if these conditions change during the assessment process. This seems a somewhat paradoxical approach if those conditions no longer exist.
