The DOJ is launching a ?new? whistleblower awards program later this year - offering $$$ for reporting corporate misconduct - and filling in the gaps left by the SEC, IRS, and other agencies. What it means... ?? Compliance officers might be able to skip internal reporting and go straight to the feds. It's similar to what we saw with the Anti-Money Laundering Act of 2020. ?? It's another reason for employees to bypass internal hotlines and go directly to Uncle Sam. It's going to be more crucial than ever to make sure your reporting channels are promoted, accessible, and trusted. ?? As always, a strong ethical culture and compliance program are the best defense. We need to work to create an environment where employees feel heard and empowered to speak up internally first. ?? In their latest push to encourage whistleblowers and corporate self-reporting, the DOJ announced the launch of its three-year Corporate Whistleblower Awards Pilot Program. This program intends to fill gaps left by comparable programs run by the SEC, CFTC, and FinCEN. Fourteen years after Congress enacted the #Dodd-Frank Act, whistleblower reward programs have proven to be an ingenious use of market forces to combat fraud and conserve limited enforcement resources. Commendable move by the Department of Justice (DOJ) USDOJ ENRD The DOJ has launched the Corporate Whistleblower Awards Pilot Program, offering #financialrewards for original, truthful information about corporate misconduct resulting in criminal or civil forfeiture exceeding $1 million. #Awards can be: Up to 30% of the first $100 million in net proceeds forfeited, and Up to 5% of forfeited proceeds beyond that amount. Additionally, a temporary amendment to the DOJ’s Corporate Enforcement and Voluntary Self-Disclosure Policy provides companies that self-report within 120 days of receiving an internal whistleblower report a presumption of declination from prosecution. This aims to encourage early #self-disclosure. Companies should now anticipate an increase in #whistleblower reports and ensure their internal processes are equipped to handle and investigate these reports efficiently. They should also review and potentially enhance their #GRC processes to ensure they are robust enough to address these new developments effectively.
