Yesterday, the Federal Trade Commission voted to ban noncompete agreements, which currently affect about 30 million employees. What does this mean? Freedom for employees to pursue outside opportunities without being tied down by restrictive contracts. The ban prohibits new noncompete agreements and mandates companies to inform current and former employees about the unenforceability of these agreements, although exceptions are made for senior executives. The FTC's noncompete ban is now blocked! Yesterday a Texas federal court enjoined enforcement of the ban nationwide. How, in a so called capitalistic, free-market economy, can a government entity decide it is lawful to ban new business start-ups by enforcing non-compete agreements? This is so Orwellian, and a throw-back to a time we really don't want to repeat. Future entrepreneurs beware. Do not sign a non-compete agreement. Or if you do, be ready to show the origins of your business ideas and operations, and make sure they are not tied to that employer.
