We are very pleased to be on the legal team for Friends of the Earth who are taking forward this vitally important case in the ECtHR. The erosion of protest rights in any democracy is too often the first sign of decay of the rule of law -we say here that 'persons unknown 'anti protest' injunctions' currently available under civil law, give corporations an unlimited free pass to close down any on- site objection to activities which are likely to adversely impact human rights now, and for generations to come. #friendsoftheearth #climatelitigation #climatejustice
Exciting news:?Friends of the Earth?has filed an application to the European Court of Human Rights in defence of protest rights in the UK.?https://lnkd.in/eygEpU8G Our case concerns persons unknown ‘anti-protest’ injunctions, which are obtained in the civil law courts. We believe these injunctions breach fundamental rights, are intrinsically unfair, amount to a privatisation of public order offences, and have a chilling effect on peaceful, lawful protest. The lack of cost protection makes it very difficult to challenge them, and the penalties for breach - imprisonment, unlimited fine and asset seizure - can be more severe than the equivalent offence under the criminal law. Their use was strongly criticised by a UN Special Rapporteur in January 2024. We’ve been concerned for years by their increasing use by?private companies, including Shell, HS2 and Cuadrilla, as well as public authorities. The?bottom line is that protest through history has been an important driver of positive change, from the movement against Apartheid, to the fight for women’s suffrage. The right to protest is fundamental to a democratic society, something that was recognised by the British lawyers who led on the drafting of the European Convention of Human Rights more than 70 years ago. At a time of climate crisis, when governments across the world are failing to take the action necessary to address this, the right to express dissent is of vital importance and must be defended. Friends of the Earth is represented in this application by Stephanie Harrison KC, Stephen Clark and Fatima Jichi at Garden Court Chambers?and by Wessen Jazrawi and Ingrid Gubbay at Hausfeld.

The corporates facilitating the fossil fuel industry say they're paying attention to the science, but they're leading us a merry dance! Have you ever seen a better visual metaphor? ?? The fossil fuel industry relies on support - from banks and financiers, from advertisers and PR companies, from think tanks and law makers, and from the legal industry, amongst others - yet many major companies within these are refusing to step away. UK law firms collectively facilitated £1,480,000,000,000 (£1.48 TRILLION) in fossil fuel projects between 2018 and 2022, with the five firms that form the 'Magic Circle' (Clifford Chance, Allen and Overy, Freshfields Bruckhaus Deringer, Linklaters & Slaughter and May) collectively responsible for £285 billion of it. https://lnkd.in/ePNdSehu In November, members of Scientists for Extinction Rebelliion joined Lawyers Are Responsible and our sister group Health for Extinction Rebellion in occupying the offices of these five firms, demanding that they withhold their services in respect to new fossil fuel projects.
