The March 1 deadline for the Emergency Planning and Community Right-to-Know Act (EPCRA) Tier II reporting is fast approaching. Is your team ready? Tier II reporting is obligatory for businesses under these conditions: - Possession or inventory of a hazardous chemical at or above 10,000 lbs., or - Possession or inventory of an extremely hazardous substance at or above 500 lbs. or the Threshold Planning Quantity, whichever is lower. Businesses meeting these criteria are required to annually submit a Tier II report to: - The State Emergency Response Commission, - The Local Emergency Planning Committee, and - The Local Fire Department(s), as mandated by State and Federal Laws. Be aware, enforcement of these regulations has intensified, leading to substantial fines, sometimes applied retroactively for up to nine years following a violation.

When a utility company is spread out over an area as large as the state of California and is experiencing an unprecedented number of wildfires as they did in 2020, understanding what types of mitigation measures need to be taken and which contractors have actually done what they were asked to do is an important part of managing vegetation correctly.? ? Clear Path was asked to assemble a team of seasoned vegetation management professionals who gathered records on 23 wildfires. We put together a records reconciliation and validation system that allowed us to ensure that the records were available for all the work performed, that the work met the proper specifications, and that all records existed and were 100% accurate.? ? Records for each fire were then archived and available for retrieval when needed.?? ? This allows decision-makers within the utility to know which contractors to deal with, what types of actions need to be taken to prevent further wildfires, and to answer questions from regulatory and legal entities looking to discover the causes and possible mitigation of some of these fires.? ? The electrical utility infrastructure had been significantly damaged, and there were hundreds of thousands of trees that needed to be mitigated because of fire damage to ensure that electrical service was restored and continued to operate safely. We were able to gather the appropriate team, develop the necessary systems, and ensure that the work that needed to be performed was to all the necessary standards.? ? This should be a wakeup call for all levels of government across the country to take dam safety seriously. America's aging infrastructure isn't limited to roadways and bridges. Many dams built during the "golden age" of dam construction in the 50's and 60's, to say nothing of those that have passed their centennial like Rapidan Dam, have seen little to no rehabilitative work in the intervening decades and it's showing. With extreme weather events becoming more and more common, this may be a scene we see repeated at dams across the country in the years to come. Blue Earth County was lucky that there was no loss of life resulting from this partial dam failure, but, the next time a dam fails, we, being the dam safety community of the United States, may not be so lucky. While dam safety and rehabilitation may not be as obvious a funding priority, it is no less critical than other areas of public safety. #damsafety #waterresources #publicsafety #floodcontrol
