The Council on American-Islamic Relations (CAIR) and its Greater Los Angeles Area office (CAIR-LA) filed a lawsuit against the federal government?for placing one Palestinian American on the No Fly List and for seizing the electronic device of another while interrogating him about organizing against Israel’s genocide in Gaza. The lawsuit is among the first to challenge the FBI’s apparent decision to target innocent people who speak up in support of Palestine and criticize Israel’s devastating violence and illegal occupation of Palestine.??

The ICJ agreed to put Israel?on trial?for genocide back in January, after hearing the case made by lawyers representing South Africa, and Israel’s response.? One might have assumed, given that genocide is the ultimate international crime, that the court would have fast-tracked a definitive ruling. After all, the people of Gaza do not have time on their side. But a year into the slaughter and imposed starvation, there is only silence. The same court has in the meantime?ruled?belatedly that Israel’s 57-year military occupation of the Palestinian territories is illegal, that Palestinians have a right to resist, and that Israel must withdraw immediately from Gaza, the West Bank and East Jerusalem. Western politicians and media have ignored the significance of that ruling, for obvious reasons. It provides the historical context for Hamas’s breakout from Gaza after its illegal siege by Israel for 17 years. Hamas is proscribed as a terrorist group in the UK and other countries. The problem for the ICJ is twofold. It is under enormous pressure from the US global superpower not to declare a genocide in Gaza by Washington’s favourite client state. Such a verdict would tear off the veil, exposing western powers as fully complicit in that supreme crime. Secondly, the court has no enforcement mechanisms outside the UN Security Council, where Washington enjoys a veto that it routinely wields to protect Israel. On much the same grounds, the ICC is also dragging its feet. Khan says he has enough evidence to issue arrest warrants against Netanyahu and Gallant for crimes against humanity. European states are obligated to enforce any arrest warrants, so unlike an ICJ ruling, this one could be carried out.?? But for months, the judges of the ICC have delayed approving the warrants, despite the urgency, apparently because they, too,?are fearful?of incurring Washington’s wrath. Both courts can be in no doubt that taking on Washington in these circumstances is a suicide mission. On the one hand, Israel has shown that it will not abide by any of the legal red lines once insisted upon by the West to avoid a repeat of the horrors of the Second World War. And western powers have demonstrated that not only do they have no intention of restraining Israel, they will assist in its violations.? On the other hand, by hesitating month after month, the two international courts discredit the very rules of war they are there to uphold. They have returned the world to an era of jungle law, but now in a nuclear age. International law is being shredded in the maw of a US-imposed, self-serving “international order”.

TIM MILLER APR 05, 2024 ..."people who live in countries run by genocidal maniacs tend to be scared to express that feeling for fear that the leader’s rage will rain down upon them. That fear is not apparent in Joe Biden’s America because people have no reason to be concerned that he’s going to target them for speaking out, particularly critics on the left. The only folks who have deluded themselves into thinking that Biden might target them unfairly are the Great Patriots who stormed the Capitol on January 6th and mauled police officers in a ham-handed attempt to overthrow the government, as well as the allies who listen to their jailhouse concerts. The problem with that group’s claim of persecution is that the perpetrators are being found guilty not by some government or military tribunal but by juries of their peers. In addition to protecting freedom of expression at home, there is not any evidence of President Biden’s supposed genocidal mania abroad. Despite the claims of many on the far left and MAGA right, the president has not started any new wars. In fact, he got America out of the decades long-war that both of his immediate predecessors had failed to extricate us from despite a stated desire to do so. (I didn’t like how he extricated us from that war, but that’s beside the point.) In addition, Biden dramatically scaled back the number of drone strikes that those presidents had executed. So clearly this is not a person with an unquenchable bloodlust or uncontrollable rage that manifests in dealing out death around the world. ... It’s not Joe Biden who is spearheading the attack in Gaza. He has repeatedly expressed reservations about the tactics deployed by Israel. Yesterday after what was reportedly a heated phone call with Netanyahu, Israel conceded to Biden’s demands that more humanitarian aid get into Gaza. ... one thing that should not be up for debate is the reckless, irresponsible claim that Joe Biden is a genocidal maniac. Because as long as some of those who should be in Biden’s camp are being convinced he might be, we are more likely to get an actual Muslim-banning maniac like Donald Trump in the White House next year."...

This is from a federal judge writing on the case…but I believe it applies to every human on this planet witnessing this madness: “"It is every individual’s obligation to confront the current siege in Gaza... as the ICJ has found, it is plausible that Israel’s conduct amounts to genocide.” To be clear, it is EVERYONE’S responsibility to speak out. If you are in government - at any level - you have a responsibility to speak against what is demonstrably a genocide. It is your public duty (not just as a human, but particularly if your country has signed the Convention on Genocide). Speaking out against genocide and a government is not bigoted or racially motivated (no matter how badly a government wants to hide behind people of faith - many of whom ARE speaking out and against this madness). However, NOT speaking out goes against human decency, common sense, and can only be described as bigoted and racially motivated…don’t be that person. Speak out! Fascists don’t stop, humans stop fascists.

This Court implores Defendants to examine the results of their unflagging support of the military siege against the Palestinians in Gaza." An extraordinary ruling by a U.S. Federal Court Judge and George W. Bush Appointee Jeffrey White, responding to Defense of Children International Palestine v Biden, Blinken & Austin. While he dismissed the case on a technicality relating to the separation of powers, Judge White's words will reverberate across the corridors of Washington. They are both a hearty endorsement (or at least as hearty an endorsement as the Bench will issue) of the Americans who have been on the streets protesting these past four months, and a stark reminder to American government officials of their complicity in Israel's actions, which will surely energize further consideration by the State Department's Office of the Legal Advisor as it considers the further provision of lethal arms to Israel. My congratulations to the Center for Constitutional Rights who argued this case. Short of an outright win that was always a distant prospect in the current legal framework regarding security assistance, this was the best possible outcome they could have achieved at this point and at this level - and no one who watched the searing testimony of the Plaintiffs last week could have hoped for anything less. Having been a small contributor to their effort is one of the proudest moments of my life. The struggle for justice continues.

US, Germany and Britain all signed Geneva convention. Biden under persuasion from Israel, made US sign it in 1988. At this point, another country needs to drag the US, Germany and Britain (None of them can run away from this, they all signed Geneva convention) before the ICJ for genocide in Gaza. When you look at what is happening in Gaza, it is now clear that the West created the Geneva convention to prevent genocide against them only, not to stop others from committing genocide against each other (reason, Biafran war was permitted and similarly Rwandan genocide, and Yemeni genocide), or the west from committing genocide against others (like in Iraq, and now in Gaza). https://lnkd.in/dwGUrD8E

It strikes me how the Gaza and West Bank ethnic cleansing (probably genocide) is all about propaganda, perception, and public relations. Hamas launched the attack on Israel, not to hurt Israel or kill Jews but to trigger an out of proportion reaction from Israel (in which it succeeded unfortunately) in order to change the perception of Israel as a loyal partner for surrounding Arab countries and to get the world on their side. Israel does not want to free the hostages (despite what they are saying) because they want to continue to flatten and ethnic cleanse Gaza for which they need a reason. Which is the freeing of the hostages. Israel wants to be seen as the victim defending itself, which is why it is trying to use the Hamas tactic and doing precise attacks in Lebanon and Iran, just enough to trigger a reaction but not to harsh to scare of US support. When Iran or Hezbollah would react with fierce power, this would allow Israel to start a war with them ("in defense") in order to distract the attention from what is going on in Gaza and the West Bank, to capture extra land, and give an important military blow to both Iran and Hezbollah. Without being seen as the agressor. No one wants to be seen as the one plummeting the ceasefire agreement. The US proposed an agreement which it said was supported by Israel, but Netanyahu contradicted this. It then got voted in the UN and when Hamas saw that Israel would not agree, it claimed that it supported the agreement (knowing that it was already out of the picture). Now, the US are proposing a new agreeement which is probably completely in line with Israeli wishes and hence is not a real ceasefire and they are trying to sell the narrative that it is Hamas that is blocking the deal. And Hamas is now cleverly pointing out that they agree with the first proposition from the US. It seems that the US have overplayed their hand because they are dealing with an unloyal partner on their side. The rulings from the ICC and the ICJ have been literally called "inappropriate" and "unhelpful" by the US for the simple reason that it destroys the idea of Israel as the victim and just defending itself. (Note that the ICJ non-binding advice can be seen as a rejection of the idea that Israel has the right to defend itself against the Palestinian territories that it occupies) Finally, you will notice that Israeli hostages that have been released will tell the press that they have been treated correctly and with humanity. This is not because Hamas are such a bunch of jolly, friendly humanitarians, but because they want to paint a contrast with the way Israeli's are treating abducted Palestinians (who are being raped, starved, and tortured). Again, they want to get the world on their side. More than 40 000 people have been killed of which many children, people are starving, getting diseases, getting legs and arms amputated, all this for a cynical international political chess game. History will not judge us lightly.

Hamas is a response to decades of brutal oppression against Palestinians, yet it's convenient for you to ignore the root of the problem. Where was Germany before October 7th? Where were you when the IDF killed hundreds of Palestinian children earlier in 2023? Who do you think the members of Hamas are? They’re the children who’ve grown up watching their families—fathers, mothers, brothers—killed by the IDF for years. Hamas isn’t the core issue; Israel played a role in the creation of Hamas. Who else would Israel go to "war" against? They need Hamas to justify their ongoing violence. And as for the same tired line—"Israel has the right to defend itself"? Maybe you should say, "Israel has the right to defend itself from the IDF." Who do you think executed the Hannibal Directive on October 7th, responsible for much of the killing of Israeli civilians, military personnel, and Hamas members? Does Hamas have tanks, Apache helicopters, guided missiles, airports, or ports? How do you explain hundreds of vehicles getting torched—by Hamas gunfire? Do you really believe Hamas, in the middle of a large-scale operation, suddenly decided to fire at hundreds of vehicles? Stop pushing this narrative and confront the real problem. Give humanity a break from your misguided rhetoric!
