#ExpertwitnessPA: I’ve talked to several PAs over the years who have turned down working as an expert witness on plaintiff cases or rejected the work altogether because the thought of working against a PA being sued was unthinkable. I think it’s human nature to feel a bit uneasy in this situation. We’ve all had difficult cases and we all have made mistakes, so I think early career experts can see this as a mental challenge. One thing I learned early on is that serving as a medical expert is not an effort aimed to judge a clinician personally or to serve as an indictment on their entire careers. I think medical experts are required to ensure that medical standards are upheld and to ensure that clinicians are working and providing care that is reasonable and prudent.?We serve as a quality control measure in a sense and we serve to educate attorneys on PA practice. For those on the fence about accepting plaintiff cases as a medical expert, I would encourage you to take the leap on these cases.?Whenever I work on any case, plaintiff or defense, I’m always left with the feeling that I’m helping to build our profession and never tearing it down. Statistics often quote the risk of being sued as around 50%. This leads to a misunderstanding that physicians are basically facing a daily coin-flip risk of being sued; today it either happens or it doesn't. That does not quite reflect the reality of malpractice risk. Up to 1 in 2 physicians (more toward 1 in 3 female physicians) may be sued over the course of a 50-year career. The odds of being sued in any one year are much lower. And who knows how many of us will complete a 50-year career given the dramatic change in most medical employment models these days.
