On June 13, the U.S. Supreme Court resolved a split in decisions of the circuit courts and made clear that the National Labor Relations Board is not entitled to a deferential standard, but must meet the same four-part test that other litigants must meet in order to obtain the extraordinary remedy of a preliminary injunction to avoid damage as a result of an employer's potential unfair labor practice. Very interesting case. I don’t do work involving union activities and soley practice discrimination matters. But this is an interesting read about the power of the National Labor Relations Board. This tests the balance of whether it can immediately order an employer to rehire an employee or matter should be preliminarily brought to a federal district court seeking injunctive relief meaning a court order to rehire pending final outcome of matter. Interesting fact though is that the NLRB has only acted with such power 14 times in the last year and there has been likely thousands of cases. This is all really an attempt by corporations to attack the very right of the NLRB to exist. No other purpose. Chipping away at its power. https://lnkd.in/g55fhzas
