Non-competition Restrictions on Maryland Healthcare Professionals to be Eliminated or Limited
Gov. Wes Moore is expected to sign a bill (HB1388) into law that will ban non-competes for certain doctors, nurse practitioners, nurses, midwives, dentists, pharmacists, psychologists, and optometrists. If signed, the law will apply to Health Occupations Article-licensed employees’ contracts signed on or after July 1, 2025. A total ban will apply to health professionals who provide direct care to patients and earn $350,000 or less a year. For healthcare professionals earning in excess of $350,000 annually, noncompete provisions signed on or after July 1, 2025, will be unenforceable if they have a (i) restricted period of more than one (1) year and/or (ii) geographic limitation greater than 10 miles from a professional’s primary place of employment. The law will also require employers, in certain cases, to inform patients when a covered healthcare professional moves to a new practice location (presumably making it easier for patients to follow the healthcare professional). In addition, effective June 1, 2024, new noncompete restrictions will be banned for employees licensed as veterinary practitioners or veterinary technicians under Title 2, Subtitle 3 of the Agriculture Article.
