Reflecting on a significant legal precedent set by the Kenyan High Court, we revisit the Traffic Act, specifically Section 70 and its subsections. Seven years ago, in a case involving Ankush Manoj Shah, the court clarified the interpretation of this section. According to Section 70 (1A) and (5B), exceeding the speed limit by 20 km/h is not considered illegal, and penalties are not applicable for this minor deviation. Therefore, if you find yourself inadvertently exceeding the limit, remember the provisions of the Traffic Act. Take a composed approach, adjusting your speed back to the prescribed limit to prioritize safety on the road. Successfully obtained a planning injunction against the defendant. Land was in a shocking state. The Council had served a section 215 notice under the Town and Country Planning Act 1990, telling the defendant to clean it up back in 2018. He didn't comply. I started Part 8 proceedings in January and had a contested hearing this April. Court granted the injunction because the planning regime has to 'have teeth'. Defendant has until 9th May to clean up or face prison for contempt of court.
