In the Foreign Extortion Prevention Act (FEPA) panel discussion before Coalition for Integrity's April Integrity Dinner, panelists Charles Duross, Michael Hershman, Mark Mendelsohn, and Mara Senn identified several practical issues that they believed could complicate both FEPA compliance and enforcement, among them certain inconsistencies between FEPA and the Foreign Corrupt Practices Act (FCPA). In July, Congress (S. 4548 – the Foreign Extortion Prevention Technical Corrections Act; signed into law on July 30, 2024) revised the December 2023 FEPA statute to better align it with the FCPA’s four decades of practice and interpretation.?The details can be found in Mark Mendelsohn' s and Benjamin Klein's “Congress Quietly Amends FEPA: What Companies Should Do Now” in the 7/26 Law360.?The definitional and jurisdictional changes to FEPA, among others noted in the article, are worthy of note.
