RULES OF ORIGIN GOODS PRODUCED IN ONE COUNTRY The international rules of origin determine whether or not goods my benefit from lower or no import duty depending on the commodity code and the trade deal in question. 1. Goods that are solely produced in one country ae the easiest to determine if import duty is payable in the country of import. 2. Natural resources such as products resulting from mining operations, fisheries, forestry as well as certain metals may benefit. 3. Use the correct commodity code and check the UK import tariff for CDS. 4. Certificate of Origin may be required to claim the benefit. 5. If you are not sure always check with your customs broker. In 2021, Canada exported significant amounts of lumber and paper to Mexico, while Mexico's timber exports to Canada were notable. CUSMA and CPTPP offer tariff benefits and market access, enhancing trade. Key legal considerations include compliance with environmental regulations, customs procedures, and intellectual property protection.
In recent years, Canada exported significant quantities of softwood lumber and pulp and paper products to Mexico, valued at approximately CAD 150 million and CAD 80 million respectively in 2021. Conversely, Mexico exported timber, logs, and processed wood products to Canada, with values around CAD 40 million and CAD 25 million. Under the Canada-United States-Mexico Agreement (CUSMA), most tariffs on forestry products have been eliminated, facilitating smoother trade through streamlined customs procedures and dispute resolution mechanisms. The Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP) further expands market access, reduces tariffs, and promotes regulatory cooperation and sustainable practices. Legal considerations for businesses include compliance with environmental regulations and certification requirements, adherence to customs procedures and rules of origin, and understanding dispute resolution processes under CUSMA and CPTPP. Intellectual property protection for trademarks and patents, compliance with labor and employment laws, and drafting clear contractual agreements are crucial. Additionally, navigating foreign investment regulations is essential for companies investing in forestry operations in Canada or Mexico. Proper legal advice and adherence to these frameworks ensure profitable and smooth trade operations between the two countries.
