Company: ExxonMobil Type: Environmental & Governance Event: Lawsuit ESGR Score: On the rise from 7.03 on August 3rd to 9.18 on September 26th ExxonMobil is under fire in California, facing two coordinated lawsuits from the California Attorney General and environmental groups. They allege deceptive marketing, concealment of harm, and violations of nuisance and unfair competition laws. The state’s AG claims include that 92% of plastic waste processed using the company’s chemical recycling technology becomes fuel rather than plastic. The groups are calling for penalties and significant changes to ExxonMobil’s recycling practices. On top of that, ExxonMobil is also dealing with climate-related lawsuits, with the number of cases nearly tripling since 2015. These lawsuits allege greenwashing and the lack of meaningful efforts to reduce emissions. Concern about plastics pollution has grown over the years as scientists learned more about its harmful impact on the environment.?So far, much of the effort has centered on recycling, but it turns out much of the waste material is incapable of being recycled. California Attorney General Rob Bonta is suing ExxonMobil, alleging the company misled consumers into believing that recycling was a viable solution for plastic waste. The lawsuit represents a new avenue in the legal fight to hold fossil fuel companies responsible for pollution. As the United Nations General Assembly gather in New York City this week, 175 nations agree to?develop a legally binding agreement on plastic pollution, prompting a major step towards reducing greenhouse gas emissions from plastic production, use & disposal. Decades of deceptive practices around plastic recycling. While ExxonMobil claims to have processed 60 million pounds of plastic through advanced recycling, this barely scratches the surface compared to the 50 million tons of plastic waste generated in the U.S. annually. Even more concerning, the process is not only inefficient but harmful, with 92% of plastic waste converted into fuels, which are then burned—adding to carbon emissions. And the staggering environmental toll? Since 1985, 26 million pounds of plastic waste have been collected from California’s beaches, with 81% linked to ExxonMobil’s polymer production. ICYMI: California and environmental groups separately sued ExxonMobil on Monday, accusing the oil giant of misleading the public about the effectiveness of plastics recycling. ? ?? ? ExxonMobil — a major producer of the synthetic substances used to make plastics — has made billions off of plastic bottles, bags and wrappers polluting waterways. (Remember: Plastic is made from FOSSIL FUEL!) ?? As ExxonMobil bumped up production, they also promoted the widely used “chasing arrows” symbol on plastic products, which led buyers to believe that their bottles and other products would be recycled if disposed of properly. But only about 5% of plastic waste in the U.S. is recycled, according to research from Beyond Plastics. Plastic recycling faces economic and technical limitations and can have negative environmental impacts. In a historic move, California made a first-ever attempt by a U.S. government official to hold a fossil fuel company accountable for allegedly lying to the public about the recyclability of plastics. ?? Several environmental non-profits including The Surfrider Foundation, Sierra Club, Heal the Bay, and San Francisco Baykeeper have also filed a lawsuit to hold ExxonMobil accountable claiming that Exxon violated California's nuisance and unfair competition laws by hiding the dangers of single-use plastics. It also alleges that Exxon misled the public into thinking plastic could be easily and safely disposed of through recycling, which has only worsened the plastic pollution crisis.???
