Who Really Profits from Your Art? The Shocking Truth About Sales Contracts That Galleries Don’t Want You to Know! What should you look out for when you're ready to sign a contract to sell your artwork? Jurisdiction Clause. You might be wondering, what exactly is a jurisdiction clause? A jurisdiction clause specifies which court will handle the case if there are any disputes between the parties regarding the execution of the contract. For example, there might be issues with contract settlement, the return of the artwork, damage to the artwork, or interpretation of the contract terms. In such cases, the court designated in the contract will handle the dispute. The jurisdiction clause is usually found at the end of the contract. Typically, it states that in the event of a legal dispute, the court with jurisdiction will be the one where the gallery or the contracting party is located. This provision is due to the fact that galleries prepare the draft contract and set the terms under which the contract will be executed. ### What Does This Mean for the Artist? Any dispute will force the artist to either travel or seek representation in the gallery's location. It’s not hard to imagine a situation where the artist lives in a different part of the country or even in another part of the world and has to travel or hire someone to represent them in a different city. ### How to Avoid Such Problems? First and foremost, read the contract carefully, make changes, and include clauses beneficial for both parties, or let someone like me review it ??
