Earlier today, the Knesset passed the International Commercial Arbitration Law, modernizing Israel’s legal framework applicable to international arbitration. The law is based on the #UNCITRAL Model Arbitration Law, which paves the way for Israel to become one of over 100 Model Law jurisdictions across the world. What are its key elements? Like the Model Law, it provides for a streamlined arbitration process, limited involvement of courts, clarity on interim measures, and greater party autonomy in designing the arbitration. The law forms part of a broader effort towards enhancing Israel's private international law framework. I wish to thank the staff on my team who saw this process through, with professionalism and dedication: Yael Weiner, Itai Apter, Cedric Sabbah, and everyone else from the private sector and academia in Israel and abroad who contributed their time and expertise along the way. Special thanks also to my predecessor, Roy Schondorf, under whose auspices and judicious guidance this process was initiated, and to Prof. Arie Reich, who was among the first in Israel – if not the first – to prompt Israel to adopt the UNCITRAL Model Arbitrational Law. Last but not least, my heartful appreciation to our friends from the UNCITRAL Secretariat, whose insight, wisdom and patience were instrumental to seeing this important project to fruition. Next steps: the law is expected to come into force very shortly, following which we will request the UNCITRAL Secretariat to add Israel to the list of UNCITRAL International Arbitration Model Law countries. Congratulations to Professor Eva Lein on the first presentation of the week at the Hague Academy of International Law in the special course entitled "Breathing Space in International Commercial Litigation." Professor Lein, a distinguished academic specializing in private international law, dispute resolution, and comparative law, holds a professorship at the University of Lausanne and serves as the Director of the Comparative Law Center at the British Institute of International and Comparative Law. Her extensive research and expertise span contract law and the implications of digitalization within legal frameworks. In today's session, Professor Lein introduced the concept of "breathing space" in international commercial litigation, particularly in response to global crises such as COVID-19. She explored how temporary legal measures during emergencies could be adapted into more flexible, permanent solutions, focusing on the rebalancing of contractual relations. The discussion highlighted examples from Germany, Spain, and the United States, where similar principles have been applied in bankruptcy and contract law. The course will delve deeper into whether we need a special contract regime for crises and how to develop a "toolbox" of best practices. As a litigator for over two decades in the United States, practicing at the Federal level, I would like to add that the concept of breathing space is similar to the "automatic stay" in bankruptcy law in the United States. During the week, I expect that we will expand on this concept to cover more permanent and ready rules that provide similar relief during times of crisis and emergency. This is an exciting opportunity to rethink how we approach private international law in the face of unforeseen global challenges.
