My two cents in a recent ETLegalWorld article on the impact of the #DPDPAct on the online gaming sector. I have weighed in on the exercise of rights as a 'Data Principal' vis-a-vis processing of children's data . The contours of the precise obligations that a Data Fiduciary will have to follow are not clear and the upcoming rules under the DPDP Act may provide the much needed nuance for data fiduciaries. Nevertheless, the DPDP Act per se does not directly address the potential dangers of user generated data through chat features or online interactions in VR or Metaverse based games and platforms. #DataProtection #onlinegaming #privacy #ChildrensData

India implemented new regulations for online gaming in April 2023 through amendments to the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 popularly called the Gaming Amendments. These amendments introduced a co-regulatory framework for the online gaming industry. Self-regulatory bodies (SRBs): The amendments establish a system of SRBs. These?bodies will be registered with the government and can register online games that comply with specific criteria.? Verification for online real money games: Online games involving real money wagers will need verification from a registered SRB to be classified as a "permissible online real money game". Due diligence for intermediaries:?App Stores, advertisers, and other online platforms facilitating online games?are required to perform due diligence. This includes ensuring the games comply with Indian law and don't cause "user harm".?
