I've spent two quarters as an ADR at Samsara, and here are the things I am going to keep doing, and the things I'm going to stop ? doing immediately: Stop doing: 1?? Getting 'pitch happy'. Gotta know when the time to pitch is versus time to ask questions. I've historically been a little quick to press the 'pitch button' 2?? Leaning too far back in my chair and almost falling over during a cold-call. This has happened at least 4 times this quarter, as embarrassing as it is ?? 3?? Saying 'Cheers' at the end of every call. I don't know if it's a San Diego thing, but I say it more often than not Things I want to continue doing: 1?? Learning about the specific problem of every account I call into. Basically just understanding their business better than anyone. 2?? Staying super deliberate with who I call and why. Having an actual reason to call/email. 3?? Learning from people around me. Having the 'dumbest guy in the room' mentality. 4?? Listening to other people's calls and implementing things I like. Q1 starts next week. Let's get it ??

It was a pleasure moderating last weeks maiden joint event of NL VYAP | Netherlands Very Young Arbitration Practitioners and the below 40 group of the Netherlands Arbitration Institute (NAI) ("NAI Jong Oranje") on the hot topic of independence and impartiality in arbitration. ? ??Together with Matthew Brown and Irina Buga we – inter alia – discussed: ? ??The importance of independence and impartiality of arbitrators in arbitral proceedings? ??Tricky distinctions (i.e. the standard to be applied with regard to challenge and disclosure and in different type of arbitrations, e.g. international vs. investment arbitration) ??Recent trends (i.e. new IBA Guidelines on the conflict of interests 2024 and the new NAI Rules 2024, under which unjustified challenges can be sanctioned by the abitral tribunal by denying further challenges) ??Considerations to be made by the parties / counsel when selecting arbitrator(s) and deciding to challenge them ??What to disclose if you are selected as arbitrator If you have questions or want to exchange thoughts please let me know.
