Ask if mediation or arbitration is required. Sometimes it may be necessary to directly negotiate or meet with people on the other side of your case. It's not always ideal or pleasant, but let's briefly discuss this scenario. Alternative Dispute Resolution, or ADR is often required by contracts and in some cases is structured into the court rules that you can't proceed until the parties have engaged in required mediation. Ask if the lawyer believes ADR is likely going to be a part of your pathway. If they believe ADR is in your future, then ask them to help you understand mediation and/or arbitration. Talk about costs and timing. Ask about outcomes that they have seen in other cases. Ask about whether you can appeal an outcome that you disagree with in ADR. Be sure to ask your lawyer to help you understand this process. If it's potentially a route your case may take, you'll want to be prepared for it.
