Ask if an expert witness is likely to be involved with your case. Let's talk about expert witnesses. They can be extremely useful in a case but there's a big reason you might not want to use them. In major litigation, there will often be a need to bring in an expert witness. These are typically hired experts in a particular field who prepare their analysis during the case, both as part of the discovery process and ultimately as part of the trial. Experts can talk about medical issues, business and economic issues, and a host of other subjects. They can be incredibly valuable to a case. Most lawyers bring experts into a case once they're sure the early discovery has not brought the parties to a settlement. The primary reason to wait for expert witnesses is that they cost a lot. They often bill more than lawyers and typically in large blocks of time. Maybe you won't need an expert, but if you have a case that goes to litigation, ask whether an expert is likely.
