Pennsylvania’s Antitrust Bill – Will It Be Passed? Health Law alert by Lamb McErlane attorneys Vasilios Kalogredis and Sonal Parekh, Esq. On April 17, 2024, House Bill 2012 (“HB 2012”) was presented, as amended, to the Pennsylvania House of Representatives. First introduced on February 5, 2024, HB 2012, if passed and signed into law, will represent and create the first state specific antitrust statute for Pennsylvania. HB 2012 was introduced with the expressed purpose of promoting free enterprise and trade by prohibiting restraints of trade that are secured through “monopolistic practices” and that act or tend to act to decrease competition in Pennsylvania. Recent discussions about potentially eliminating no-fault divorces have raised significant concerns among legal professionals. Motions for reconsideration are used in New Jersey under the right circumstances. A motion for reconsideration is a legal document filed after a court decision that allows parties to ask the judge to reconsider the outcome of a case. However, they cannot be used just because a party disagrees with the Judge’s decision. Motions for reconsideration can only be filed if there is a clear demonstration that the judge’s decision has fallen into a specified category of error. On May 8, 2024, Governor Josh Shapiro signed into law Act 2024-12, which establishes a formal arbitration process for resolving family law disputes in Pennsylvania. The new law takes effect on July 7, 2024. Arbitration is an alternative to traditional courtroom litigation, where the parties agree to have their divorce, support and other family law issues decided by a neutral third-party arbitrator instead of a judge. In her blog post, family law attorney Dori Green provides several advantages and potential disadvantages to arbitration, and concludes that the new arbitration law is a positive step in giving Pennsylvania families more options for resolving their disputes outside an overloaded court system. https://lnkd.in/ebSE8dJP #HASPSFamilyLaw #Arbitration
