The deleted messages contained business-related information, and the deletion took place after the employee had been informed about the Commission's inspection". A couple of takeaways: ?? The Commission detected the deletion itself. Specialised IT tools "allow the Commission to inspect the company's IT systems and search for the relevant data, including deleted data". "You saw that in the trending in the UK topics, you saw that disinformation cropping up under searches for Southport..." [1] We are seeing some improvements to slow the spread of disinformation/misinformation. WhatsApp have said "In 2020, we set additional limits for messages that have been forwarded many times (at least five times), so that they can only be forwarded to one chat at a time. Back then we saw a drop of over 70% in these kinds of messages." [2] With the ongoing UK riots, this is putting a large spotlight on online platforms and their role in the spreading of false information. "[X] could more fully enforce its rules against hate speech, to at least temporarily limit the accounts that are posting it, or it could rethink its verification tools that mean anyone can pay to have their content boosted." In today’s digital era , WhatsApp messages have become a most common and important form of communication. We use WhatsApp to communicate and at times we do show our frustration to the other person which is recorded as evidence. . Now the biggest concern is “Can these WhatsApp Messages Be Used as Electronic Evidence in Court?” The Short answer is “Yes”. But there are certain things to be considered for these messages to be admissible in court. These messages should be relevant to the case at hand. If a message is crucial to proving a point or establishing facts, it can be presented as evidence. The most important factor is courts require proof that the messages are genuine. This can involve demonstrating the identity of the sender and ensuring the messages haven’t been tampered with. The other legal challenge that should be considered is not to Violate the Privacy of any third party. As per Justice K.S. Puttaswamy Judgment; Right to Privacy is also a part of Right to Life. Hence while using the WhatsApp chat, we should always remember that privacy laws and consent come into play when sharing private communications, especially if they involve other parties. In order to make it more authenticate, WhatsApp messages can be submitted as electronic evidence along with a testimony by the technical expert as how the data has been retrieved and preserved. In the landmark case of "State of NCT of Delhi v. Ankur @ Akshay & Ors" (2013), the Delhi High Court ruled that WhatsApp messages, like any other electronic communication, could be used as evidence if they are authenticated. The Court accepted the messages in this case, after verifying their authenticity, and allowed them to be presented in the trial. Court fines TikTok $28,800 for violating procedure for restricting access to information TikTok was twice brought to administrative responsibility under a similar article in 2024, having been fined 4 mln rubles ($38,277.7) in July and November MOSCOW, December 27/ Moscow's Tagansky Court imposed an administrative fine of 3 mln rubles (28,800) on TikTok, finding it guilty of violating the procedure for restricting access to information, the court's press service told TASS. "By a decision of the Tagansky District Court of Moscow, TikTok Pte Ltd was found guilty of committing an administrative offense under Part 2 of Article 13.41 of the Code of Administrative Violations of the Russian Federation (violation of the procedure for restricting access to information, information resources, access to which is restricted under the legislation of the Russian Federation). The court imposed a fine of 3 mln rubles," the report said. TikTok was twice brought to administrative responsibility under a similar article in 2024, having been fined 4 mln rubles ($38,277.7) in July and November. Thus, the total amount of the fine this year reached 11 bln rubles ($105,260.54). #business #finance #financialservices
