How would you prefer to spend your time: reading Shakespeare or privacy policies? The Office of the Privacy Commissioner of Canada (OPC) published its report on deceptive design patterns (https://lnkd.in/g--ZwuHJ) alongside and in comparison with the FTC/ICPEN/GPEN survey: majority of websites and apps use dark patterns in marketing subscription services (https://lnkd.in/e-HkCm_z). - 99% of websites and apps reviewed contained at least one indicator of deceptive design (compared to 97% of the global?GPEN?result). - 96% of the cases (89% globally), the privacy policies on websites and apps were either excessive in length (over 3,000 words) or used technical and confusing language, making them difficult to read and understand. ???Now let’s do the math! On average it takes 4 hours to read Shakespeare’s Hamlet, which is approximately 30,000 words. In the time it would take to read just 10 lengthy and jargon-filled privacy policies, you could read Hamlet in its entirety! The same goes for Dark Patterns Deceptive design can also be time-consuming, taking users through lengthy journeys to opt out of privacy-invasive settings. How much of your life is spent having to navigate these online issues? Let’s simplify everyone’s life and create policies that are understandable, attuned to the user, and free of jargon. The Office of the Privacy Commissioner of Canada has released its findings on deceptive design patterns, also known as dark patterns. The OPC has made this clear that Accept and Reject choices should be equally prominent. You cannot keep Accept All more colorful and bold than Reject All and you cannot keep Reject All outside of the banner, distant from Accept All in grey and less noticeable space. Both needs to be equally prominent and equally noticeable to an end-user. Although Canada still allows opt-out. This last weekend before the Holidays might be filled with making (or if you’re more like me, taste-testing) these types of cookies but their #trackingtechnology namesake is something to be sure to keep in mind for 2025. Back in July, the New York Attorney General’s Office issued both consumer and business-directed guidance on website privacy controls, even though New York still doesn’t have a comprehensive #dataprivacy law.?It went out of its way to note that online privacy related representations and practices are squarely subject to existing #consumerprotection laws and the associated unfair and deceptive enforcement powers – a position shared by many state AGs. Last week, France’s Data Protection Authority (which formalized its collaborator status with the California Privacy Protection Agency this summer) issued orders to several websites directing that they modify their cookie banners to ensure they (i) don’t use #darkpatterns, i.e. manipulative designs, and (ii) make rejecting a tracker as easy as it is to accept it. History is a great teacher.?Among the lessons we can learn from this year is that enforcement authorities typically show a bit of their hands before bringing formal actions. So, as we move forward into the New Year, it may make sense to check in on the accuracy of our website tracking statements and the transparency of corresponding #UX, privacy controls and practices.

There is some form of harmful design found in more than 75% of websites and apps. We’re part of the Global Privacy Enforcement Network (GPEN) which published the results of our sweep which examined 1,000+ websites and mobile apps. The sweep found that above 75% of them contained deceptive design patterns that made it difficult for users to make privacy-protective decisions. Deceptive design patterns are when websites use techniques which means people give up more of their personal information than they want to. Collectively, we’re calling for businesses to stop using design practices that could undermine people’s control over their personal information. Here are some of the key findings from the GPEN sweep: ? The most common types of deceptive design patterns were obstruction/interface interference. Last year we published a joint paper with the Competitions and Markets Authority that set out the pitfalls of harmful design and advise what organisations should do: https://lnkd.in/gv3WvWCE ?
