??New changes to Charity Law came into force on March 7th, 2024?? These changes include new statutory powers for trusts and unincorporated associations to use when making changes to their governing documents. Additionally, new rules have been introduced on how unincorporated charities must pass trustee and member resolutions. Furthermore, the Act introduces a new power for the Commission to give public notice to, or direct charities to give notice to, regulated alterations carried out. There are also additional provisions relating to the selling, leasing, or disposing of charity land, concerning disposals or taking out of mortgages by liquidators, receivers, mortgagees, or administrators. One notable change permits charitable gifts given to charities that have subsequently merged to take effect as if the gifts were made to the charity they have merged with. In this LegalEASE blog post, we explore the unique nature of government entities, which differ from traditional NGOs, nonprofits, and 501(c)(3) charities. Government entities often give and receive charitable grants and can benefit from certain tax exemptions. They are also included in the NGOsource repository, in the form of public universities, hospitals, municipalities, and others. The Government of Canada recently released Canada’s “2024 Budget.” The plan contains several items of interest for charities, not-for-profits and donors, so our charities & not-for-profits law and tax lawyer, St.John McCloskey, has compiled a brief overview of them. Not quite all change but a few important changes to note in Scottish #charitylaw
A number of changes to charity law in Scotland came into force on 1 April 2024, with the introduction of the Charities (Regulation and Administration) (Scotland) Act 2023. The Act, passed by the Scottish Parliament on 28 June 2023, provides updates to the current laws under the Charities and Trustee Investment (Scotland) Act 2005.
