A new toolkit designed to enhance ethical business practices within Thailand’s automotive supply chain. The International Labour Organization (ILO) has introduced a new toolkit designed to enhance social dialogue within Thailand’s automotive supply chain, promoting responsible business practices in the sector. Social dialogue, as defined by the ILO, encompasses all forms of negotiation, consultation, or information exchange among governments, employers, and workers. An ILO report highlighted the need to strengthen social dialogue and representation in the automotive industry to address issues such as discrimination, excessive working hours, and inadequate training and career development. In response, the ILO’s Resilient, Inclusive, and Sustainable Supply Chains (RISSC) project in Thailand has created a practical toolkit to improve social dialogue between employers and workers at the enterprise level. This toolkit, targeted at company managers and trade unions, aligns with national and international standards and emerging supply chain requirements. It features three main components: detailed guidelines, interactive training sessions, and mentoring and advisory services for Thai automotive businesses. To launch the toolkit, a training session was held in Bangkok on September 9-10, 2024, with 70 participants from government bodies, employers' associations, trade unions, and automotive companies. This training demonstrated how to effectively utilize the toolkit. David Williams, Manager of the RISSC Project in Thailand, emphasized the importance of social dialogue and representation, noting that these elements are crucial for improving decent work conditions and business outcomes. He added that effective social dialogue enhances human rights due diligence and helps manage labor risks in automotive workplaces. Thailand, a leading global automotive producer and exporter, has a sector that includes major multinational companies and a broad supply chain, contributing over 10 percent to the nation’s GDP and employing nearly one million workers. Improving human rights due diligence in global supply chains requires supply chain transparency. Period. We have been stressing the need for supply chain transparency for years. The public communication of the names and addresses of suppliers throughout the supply chain - from raw material to end product - is essential for proper human rights due diligence. Disclosing such information should not be negotiable or avoidable by companies, large or small. ?? Under the UNGPs and OECD Guidelines, companies have a responsibility to know their value chain. External disclosure is essential to assess, identify, address and prevent risks of human and labour rights abuses in supply chains. ?? Supply chain transparency is also essential for the safety and protection of workers' rights. It improves access to redress for affected workers and communities. ?? In addition, chain transparency enables cooperation between companies that source from the same suppliers. However, companies need to be able to find out which other buying companies are buying from their suppliers. The progress on supply chain transparency by international operating companies has been too slow and far from complete. Moreover, it appears that companies provide little information about their supply chains beyond the direct suppliers of finished goods. Many companies do tier 1 due diligence in their supply chain. Relying mainly on 3rd party audits from a distance. It will be interesting to see the enforcement of new legislation on supply chain transparency. As an individual who has traveled to mills, factories and beyond throughout the world in my career, I have to say total transparency is hard but not impossible. The first rule is having people you trust on the ground. The second rule is, if the cost is that low red flags need to go up. In countries where there is extreme poverty such as Egypt, child labor is rampant. It is ignorant and or foolish to believe that your supply chain is free of child labor. However, not condoning child labor, but understanding the social economic situation in those regions is key. Working to become part of suppliers & organizations to uplift the local population from poverty by creating a living wage and creating systems for children to be educated is the only way to avoid these disasters. But again I cannot stress the importance of being in the facilities in person. Not the air conditioned conference rooms but the floor of factories, mills and even farms. I remember walking the floors of a factory once with my boss and he commented "This is a good factory". I asked him what makes him say that despite the obvious appearances. His reply was the workers faces look well fed. Sometimes it's not the obvious. Another time I was in footwear factory and it was immaculate and well run, However, as I walked the floor of the facility ( I was being escorted by the floor manager). I notice one worker was cutting away at a piece of leather and the scraps fell on the floor as we walked by. The manager immediately rushed over and picked it up and gave a hard stare to the worker. The worker in an instant had a flash of fear in their eyes. This was a huge red flag and made me aware this was obviously a staged visit and I would have to do unannounced visits.

?? Excellent news coming out of Brussels today, the Forced Labour Regulation has been adopted by EU member states. ?? This regulation signifies a significant step forward, banning products manufactured with forced labour from entering the EU market. ?? Many companies have tried to address forced labour risks for a long time. Outlined below are the main challenges with those approaches, with a particular emphasis on fashion supply chains. ?? The document also highlights a 5-step action plan for companies to tackle challenges relating to forced labour head-on. ?? It's important to note that this action plan is applicable across various sectors. ?? Overall, this development reflects a significant stride towards creating more just and sustainable supply chains, where human rights are respected and protected. This fortnight, we recommend reading a guest blog that has featured on the BHRRC website this week, entitled,?Labour abuse at suppliers’ suppliers – how should brands respond? The authors are from BHRRC themselves, Transparentem, SOMO, and Serve the People Association. ? https://lnkd.in/exSM43N5 ? The authors write: "Internationally-accepted standards of due diligence require global brands to take action in response to serious abuses across supply chain tiers, even if the brand has reason to believe that material from the supplier’s supplier does not enter the brand’s products." ? In addition to their argument that this is an accepted standard of due diligence, they also explain the risk of "abuse-spillover": ? "The presence of severe labour abuses beyond the first tier of supply chains - at the suppliers’ suppliers - raises serious red flags about the adequacy of the supplier’s due diligence. When a supplier uses similar materials from different sub-suppliers, it may be difficult for the brand to be sure that intermingling has not occurred. If the brand does not work with its supplier to ensure labour issues at all sub-suppliers are addressed and prevented, then the brand likely does not have a sufficient basis to trust its supplier’s due diligence and transparency on related matters." ? They further make the point that if it is later found that the brand is wrong and its products are directly linked to an abusive sub-supplier, there will be a case to make that the brand actually?contributed?to those abuses by its negligence. ? Great news: The European Parliament officially approved the CSDDD legislation on 24 April. The law obliges companies to act with due care when it comes to human rights and the environment. Companies can be held liable if they profit from child labour or forced labour in their production chain, for example. The now-adopted version of the directive has been considerably watered down. Still, we consider this legislation a gamechanger for improving labour rights of workers in supply chains world wide . Companies must conduct human rights and environmental due diligence in their value chains in proportion to size and circumstances. Trade unions can play a crucial role in conducting human rights due diligence in this context. How? These are the tools that can be used during the HRDD process. 1 Social dialogue?is an important part of the HRDD process, especially during the first step. Social dialogue involves communication between unions, employers and governments on socio-economic issues. This can be through negotiations, consultations or information exchanges, with the aim of finding a joint solution between employers and employees. ? 2 Our CBA Database?is an important tool, developed by CNV. CBA stands for Collective Bargaining Agreement, a legal labour agreement between the union and the company. With this database, an existing CBA can be analyzed in quality and compared with international ILO labour standards and national laws. ? 3 Our?Fair Work Monitor?is a tool that can be used to get more information about workers' working conditions. This is a digital survey that can be completed anonymously and voluntarily. The impact of modern slavery on the textile industry and its supply chain performance. The revenue of the global apparel market exhibited a gradual rise between 2015 and 2020, which has been attributed to the impact of the COVID-19 pandemic (Statista, 2022). The projected value of the mentioned metric is expected to increase from 1.53 trillion U.S. dollars in 2022 to 2 trillion U.S. dollars by 2027 (Statista, 2023). Unfortunately, modern slavery, including forced labor, human trafficking, and indentured servitude, is pervasive in the industry (Richards, 2022). The prevalence of forced labor, human trafficking, and indentured servitude in the textile industry is unsettling. Long work hours, low pay, and physical abuse are among the exploitative conditions that workers face (Hine, 2014). This issue has been made worse by the industry's reliance on low-cost labor and its engagement with nations with insufficient or non-existent employment standards (Cole, 2021). Modern slavery has a significant impact on the supply chain of the textile industry. Forced labor, human trafficking, and indentured servitude disrupt supply chain operations by introducing risks like labor shortages, unrest, and illegal employment practices (Hine, 2014). In addition to violating basic human rights, these practices result in reputational damage, legal consequences, and financial losses for the companies involved (Richards, 2022). Ethic minority groups are still facing these challenges in the UK manufacturing industries and their supply chains following the establishment of Modern Slavery Acts by the UK government in 2015. The UK's Modern Slavery Act has inspired a response in the construction and facilities management industries, with a focus on motivation, risk hotspots, and issues (Trautrims, 2020). However, the Act does not adequately address the challenges faced by new and rising ethnic minority company communities, especially in shifting from informal to formal firm activity (Sepúlveda, 2008). The Act's effectiveness is further hindered by legislative and required disclosure issues with global supply chains, such as industry opposition and disclosure constraints (Odia, 2019). Despite these issues, the Act has boosted awareness of human rights concerns in global supply chains, especially in the public sector, and launched a process to comprehend these risks and duties (Martín-Ortega, 2017). This study suggests that the Global Modern Slavery Act needs to be established by the United Nations across all global supply chains. It advocates for the use of lean supply chain management and sourcing strategies as frameworks to achieve this objective. Secondary data sourced from academic literature will be utilised to analyse the prevailing issues and formulate recommendations.
