Justice served: two vehicle suppliers held accountable for violating the Consumer Protection Act. Two vehicle owners, frustrated by substandard repairs and shoddy workmanship, have finally received justice through rulings by the National Consumer Tribunal. The National Consumer Commission (NCC) investigated complaints from consumers who alleged that Supertech Motor Holdings (Pty) Ltd, trading as BMW, and Spares for Africa CC had violated provisions of the Consumer Protection Act (CPA). In the first case, a consumer brought their vehicle to Supertech for repairs, paying R19 974.47. Despite the payment, the consumer was left dissatisfied with the quality of the work. Following an NCC investigation, it was found that Supertech had breached section 54(1)(b) of the CPA, which requires suppliers to perform services in a manner that meets the reasonable expectations of consumers. The Motor Ombudsman has reported the highest ever volume of service and repair cases brought by consumers to its dispute resolution service during the third quarter of the year. Between 1st July and 30th September 2024, the Ombudsman for the automotive sector received a total of 1,586 new submissions from motorists, up 18% from 1,348 in Q3 2023. This was slightly off the all-time high of 1,657 service and repair cases logged in the second quarter of this year, but nevertheless reflects the increasing number of consumers turning to The Motor Ombudsman for help concluding disputes in a fair and impartial setting, against a backdrop of growing awareness of the organisation and their rights, coupled with strained motorist finances. Judge Benitez who originally handed down the preliminary injunction on December 31, 2019 has now decided that the issue is not for the judicial branch but the legislative branch and voters. Quote from Judge Benitez's latest decision... “Remedying complexities and perceived deficiencies in AB5 are the kind of work better left to the soap box and the ballot box than to the jury box,” Benitez wrote in his decision. “If sufficient political or economic pressure can be brought to bear by (CTA and OOIDA) and their supporters, the more onerous provisions of the statute can be amended.
