It was quite a thrill to discuss the development of state privacy law at this week's National Conference of State Legislatures 2023 Legislative Summit on a panel with privacy law trailblazers Texas Representative Giovanni Capriglione and Connecticut Senator Bob Duff as well as the incomparable Keir Lamont. Here are some of the highlights: 1?? Keir remarked that the US is now the only G20 country without a comprehensive national privacy law but the states are filling the gap with Washington Privacy Act variants. With 7 (or 8 if you count Florida) states passing laws so far in 2023, approximately a third of the country's population will be covered by a state privacy law in the coming years. 2?? 2023 saw an explosion of sectoral state privacy laws, including health data privacy, children's data privacy, and data broker laws. Washington's My Health My Data is of particular note given its private right of action. And, all eyes are on what will happen with the NetChoice lawsuit over California's Age-Appropriate Design Code Act. 3?? Representative Capriglione gave a great overview of his multi-year journey to pass a privacy law in Texas, including some of the ways his law is unique as compared to the other WPA variants. He noted engaging in extensive stakeholdering as a key to getting his bill passed, having received comments from "around the world." 4?? Senator Duff provided wonderful insight on the Connecticut experience. Connecticut has passed significant privacy laws in each of the last two sessions and will tackle AI next year with Senator James Maroney leading the charge. Connecticut also will be part of a multi-state work group with lawmakers from other states, including Colorado Senator Robert Rodriguez and Minnesota Representative Steve Elkins, looking at AI legislation. I found the highlights you shared about state privacy laws to be fascinating. It's impressive to see the states stepping up to fill the gap in the absence of a comprehensive national privacy law. The explosion of sectoral state privacy laws, including those focused on health data, children's data, and data brokers, is also worth noting.
