?? Jury integrity is the foundation of our justice system and a juror’s undisclosed conflicts of interest completely undermine the fairness of a trial. ?? A retrial on damages-only, of our 2023 medical malpractice case resulting in a $7M verdict, took place last week in Syracuse, New York. The second jury returned their $1.55M verdict against the doctor who previously found 100% negligent. Post-trial, we discovered evidence that the foreperson failed to disclose that her husband, who works at the same hospital where the malpractice occurred, has been sued for medical malpractice four times in Onondaga County—including a case pending before the same court overseeing our trial. The Plaintiff, our client, has filed a motion to set aside the verdict and hold the juror in civil contempt. Stay tuned. ?? I recently resolved a case for a remarkable husband and wife against their apartment complex for a substantial but confidential amount. It's an interesting hybrid product-meets-premises liability case. ?? The community's gas BBQ expelled a burst of flames and hot vapor shortly after the husband lit it, intending to cook some steaks. He was severely burned. Although his wife was in their apartment when this occurred, we brought a loss of consortium claim for her. ?? The typical comparative fault defense loomed large, but ultimately, the apartment complex's insurer understood the risk profile and resolved the case before it was too late. It helped that their assigned defense counsel was experienced and knew what she was doing to spare her client a trial where an excess verdict was likely. ??
