Lawyers: Are you just requesting the “Designated Record Set”? You might be missing critical medical data. Under HIPAA, the Designated Record Set (DRS) includes core medical and billing records. But under the 21st Century Cures Act, Electronic Health Information (EHI) goes further—care team notes, digital monitoring data, communications, and more. Why it matters: The EHI may contain timeline discrepancies, treatment decisions, or case coordination notes that never show up in a standard DRS request. If you’re only asking for DRS, you could be settling a case with half the story. Know the difference. Demand the full record. #LegalTech #MedicalRecords #HIPAA #CuresAct #PersonalInjury #TrialLawyers #InformationBlocking

Attention NYS Academy of Trial Lawyers members. Important HIPAA & 21st Century Cures Act Updates for?Trial?Lawyers webinar featuring our guest speaker attorney KENNETH LITMAN and CEO of YoCierge Inc. George Bessenyei Navigating medical record access in personal injury cases just got more complex—and more critical. Recent updates to HIPAA and enforcement of the 21st Century Cures Act have significant implications for how attorneys obtain and use protected health information (PHI). As?trial?lawyers, understanding these changes is essential to protecting your clients’ rights and ensuring timely access to the medical records you need for your cases. Key highlights: ? Individual Right of Access is being strictly enforced—delays or unreasonable barriers by providers can now lead to OCR penalties. ? The Information Blocking Rule prohibits healthcare entities from interfering with access, exchange, or use of electronic health information (EHI)—this includes records requests from authorized legal representatives. ? Designated Record Set vs. EHI—know the difference and how it affects your request strategy. ? HIPAA-covered entities must respond to access requests within 30 days, with limited extensions. ? Tools like APIs are becoming central to record retrieval—are you integrating the right solutions? Stay informed. Stay compliant. Stay ahead. Have questions or want to learn more? Is Your Law Firm Truly HIPAA Compliant? Here’s What You Need to Ask. Law firms handling personal injury, medical malpractice, or healthcare-related cases regularly deal with protected health information (PHI). But are you really HIPAA compliant? Unlike healthcare providers, law firms aren’t automatically classified as covered entities under HIPAA. However, if your firm requests, stores, or transmits PHI—especially through third-party record retrieval services—you must follow strict security and privacy protocols. ?? Key Questions to Ask About Your Firm’s HIPAA Compliance: 1?? Do we have a Business Associate Agreement (BAA) in place? ? If your firm uses a vendor for medical record retrieval, cloud storage, or case management, a BAA is legally required to ensure HIPAA compliance. 2?? How do we securely store and transmit PHI? ? Are records encrypted at rest and in transit? ? Are we using secure portals and email encryption instead of regular email for PHI? 3?? Who in the firm has access to medical records? ? Are we practicing role-based access to limit PHI exposure? ? Do we have multi-factor authentication (MFA) in place for added security? 4?? Are we maintaining proper audit logs? ? HIPAA requires firms to track access and modifications to PHI. Does your system generate logs in case of an audit or breach? 5?? What’s our breach response plan? ? If PHI is compromised, how quickly can we detect, report, and mitigate a breach? ?? Pro Tip: If you’re working with a third-party medical record retrieval service, ensure they follow HIPAA, HITECH, and the 21st Century Cures Act for interoperability and compliance. Law firms can no longer afford to overlook these security measures. Is your firm prepared? Let’s discuss! ?? #HIPAA #LegalTech #LawFirmCompliance #MedicalRecords
