    For many entrepreneurs and skilled professionals, the E-2 visa is a great option to live and work in the U.S. However, not everyone qualifies for the E-2 visa. If you find yourself in this situation, don't worry—there are alternative pathways to help you reach your goals! As background, the E-2 visa is a non-immigrant visa for individuals from countries that have a treaty with the U.S. and are looking to invest a substantial amount of capital in a U.S. business. But what if: 1. You’re from a country that doesn’t have a treaty with the U.S.? OR 2. You don’t have the required funds to make the investment? These are just a couple of reasons why the E-2 might not be an option for you. Fortunately, there are other visa types that can serve as excellent alternatives: EB-1A Visa: Extraordinary Ability: The EB-1A visa is for individuals who can demonstrate extraordinary ability in their field—whether it be business, science, education, arts, or athletics. If you have a proven track record of achievements, such as awards, published works, or significant contributions to your industry, you may qualify for this immigrant visa. The best part? No need for a job offer or investment funds. The EB-1A is a self-petition visa, allowing individuals to apply on their own. National Interest Waiver (NIW) Visa: The NIW (National Interest Waiver) visa is available to those who can demonstrate that their work has a significant impact on the U.S. national interest. Individuals who can show that their skills will benefit the country in areas like business, healthcare, science, or technology may qualify for this immigrant visa. Like the EB-1A, the NIW does not require a job offer or investment but focuses on the value of your contributions to the U.S. If the E-2 visa isn’t an option for you, the EB-1A and NIW visas offer powerful alternatives for skilled individuals seeking to live and work in the U.S. They may require a different approach, but with the right qualifications, they could be your ticket to success. And, the EB-1A and NIW visas are immigrant visas, which means that once you have an approved EB-1A or NIW petition, you have a direct pathway to apply for a green card. The E-2 visa is a nonimmigrant visa and an approved E-2 visa is not a direct path to a green card.     Grateful for this five-star review from a recent #EB1A client to kick off the weekend! This client described his EB-1A application as "perfect," but I am not sure if such a thing exists. There was a lot of creative lawyering that went into this petition, as well as the client stepping in and doing the heavy leg work with document production to push this case to the finish line. While this client was certainly accomplished, as an attorney, you are never 100% sure whether a case will be approved until it is.     EB-1A approval for a client in the ballet field! I co-counseled this case with Apfel and Associates P.C., and we were able to get this case approved without a Request for Evidence (RFE). This case was particularly rewarding because our client had extensive professional experience as a ballet dancer but was coming to the U.S. with the intention of teaching ballet. This presented a unique challenge — how do we frame the field of endeavor in a way that highlights both the performance and the teaching of ballet, while meeting the EB-1A criteria?     EB-1A approved for a materials scientist!! This client was more than deserving of the approval. He conducted cutting-edge research that tackled the water scarcity in the world, made clean water more readily available, improved transportation technology, among more. He had 50+ publications in peer-reviewed, scientific journals, 8 patents, 30+ presentations, managerial roles at distinguished organizations, awards, and more. Even though it was a "slam dunk" EB-1A case, it still required careful drafting of letters, document presentation, and a detailed plan of what he will do in the U.S. once his green card is approved. This client was a great EB-1A candidate. There are many individuals who do not have the credentials to qualify for a EB-1A and believe that they can "buy" their way to an approval. I highly discourage this approach. I am seeing a lot of people these days pay journals to publish their work or pay media outlets to do an interview with them. Not only is this unethical in the professional world, it is also considered as misrepresentation and fraud in the immigration landscape. I am not saying that everyone who gets an EB-1A needs to have all the credentials as the client whose case was approved today though. Everything is case by case and there are plenty of EB-1A approvals that did not have 50+ publications, multiple patents, and so forth.     Foreign nationals with an advanced degree or exceptional ability who have already gone through the PERM process and have an approved I-140, may benefit tremendously from applying for a National Interest Waiver (NIW). When you apply for a PERM, your employer sponsors you for the green card application. This means that you must remain employed with your current employer to secure your green card through this process. Unlike the PERM process, a NIW allows foreign nationals to self petition for their green cards, which means that they are in liberty to work for another employer. If you have an approved I-140 through the PERM process, you will be able to secure that priority date, apply for the NIW, and if the NIW is approved, switch to another employer either on a non immigrant visa or with your approved green card (assuming that your priority date is current at this time). For skilled workers, this has tremendous benefits because it gives them the freedom to work for other employers without feeling pigeonholed because their PERM sponsoring employer is controlling their future as legal permanent residents. #NIW #EB2 #PERM #greencard #visas #immigrationattorney #immigrationlaw #foreigntalent #employment #highlyskilled

    If you have a visa interview (for a non-immigrant visa or immigrant visa) coming up at a U.S. consulate or with USCIS, here are some general tips to keep in mind: 1. Make sure that you have the originals of the evidence you submitted (i.e., birth certificates, marriage certificate, passport, etc.). In addition to that, I always advise clients to take the entire package of their filing with them. 2. Listen to the question closely and only answer the question being asked. 3. Let the officer know if you do not understand a question, and DO NOT (and I mean DO NOT) guess on an answer to a question. The last thing that you want to do is provide false statements to a question that you simply just needed to hear one more time. 4. Remain poised and calm, even if the officer is not. Some officers are really nice, but some are not. Do not let their behavior dictate your responses or reactions. 5. Tell the TRUTH because if you do not, then you have just opened an entire can of worms. Misrepresentation or fraud can lead to long term consequences for your immigration case, so just tell the truth.     Trump 2.0 is expected to impact business immigration, but how it will exactly still remains unclear. For example, under Trump 1.0, there were stricter evidentiary requirements applied in #NIW cases and #EB1A cases, with more #Requestsforevidence. Trump 2.0 has not explicitly addressed how it will handle these cases, but immigration attorneys are gearing up for battle.
