A care home operator has successfully challenged the Home Office’s decision to refuse a defined certificate of sponsorship request on the grounds that the care home could not provide official contracts for guaranteed hours of work to show that the jobs were genuine. The care home operator provided contracts with three local councils. They were all flexible contracts which made no guarantees as to number of users or staff, which is common in social care where local authorities do not commit to long term contracts. The courts view: ?Such contracts simply did not exist as standard contracts in the care sector. The Defendant was requesting evidence that it was impossible for the Claimant and others to provide and which had little or no bearing about whether there was a particular job vacancy within one of their care homes. #carehomes #caresector #carers

UK employers sponsoring migrants face harder sanctions and visa cost clawbacks. According to a UK Home Office?announcement?stronger measures are now to be added to the Employments Rights Bill to punish employers sponsoring migrant workers who pay less than the minimum wage or “repeatedly defy visa rules.” Other additions to the Bill passing through Parliament currently are set to curtail the practice of clawing back visa costs from sponsored employees. Migration minister Seema Malhotra adds: “no longer will employers be able to flout the rules with little consequence or exploit international workers for costs they were always supposed to pay if they choose not to recruit domestically…?workers coming to the UK to support our health and social care service have all too often found themselves plunged into unjustifiable insecurity and debt. Nearly 200 care providers have been given government licences to bring foreign nurses to the UK despite having previously violated labour laws. It will now prove an early test for Labour’s new employment rights enforcer, which the government?has promised?as part of its workers’ rights package. The Guardian?revealed this year?that many of those who come for work are not given the jobs or the hours they were promised, despite in many cases having paid tens of thousands of pounds to companies to secure their jobs and travel. The Work Rights Centre study shows at least 1 in every 14 companies with a licence to sponsor foreign workers has previously violated employment regulations, whether by offering substandard care, paying less than the minimum wage or breaching health and safety rules. Employers face overseas worker ban in visa law crackdown Employers who flout?visa rules?could face lengthy bars from hiring foreign workers, as part of a crackdown on abuse and exploitation. Migration minister Seema Malhotra said the Government was committed to “ensure those who abuse our immigration system face the strongest possible consequences”. The?Home Office?says overseas workers who have joined the UK care sector have been particularly vulnerable to exploitation. Some 450 sponsor licences in the sector have been revoked since July 2022, and work is taking place to help care workers into alternative jobs when their sponsor has lost their licence.
