A Landmark Win for Justice & Child Safety! We’re thrilled to share a major victory?for Jon Noyes, Kayla Carmosino, and Bill Winingham, who successfully won an appeal before the Indiana Court of Appeals?in a case against the Department of Child Services (DCS). In this heartbreaking case, DCS removed a child from his mother’s care?and placed him in a foster home where he was sexually abused.?Even after receiving notice of the abuse, DCS failed to remove the child for his safety,?allowing the abuse to continue. The child’s mother sued DCS for failing to investigate and protect her son, but the lower court dismissed the case, ruling that DCS was immune. Jon, Kayla, and Bill fought for justice on appeal, arguing that DCS was not immune?and that allowing immunity would put Indiana’s foster children at risk.?Jon presented oral arguments before the Court of Appeals on February 18, and on March 12, the court unanimously reversed?the lower court’s decision, ruling that DCS was not immune under these circumstances. This groundbreaking decision?is a huge win?for foster children across Indiana, ensuring greater accountability and protection?for those in DCS’s care.
