Great discussion on the last day of the Wolters Kluwer #CRAfairlending Colloquium. My colleague Ken Scott and DOJ civil rights attorneys Jennifer Slagle Peck and Jon Seward delivered excellent insights on what DOJ redlining consent orders can teach lenders about how to avoid redlining risk and proactively reach the communities they serve.

Win-Win Solutions, LLC is dedicated to helping all lenders transform redlining risk into valuable opportunities. Jon Seward was the Principal Deputy Chief in the Housing Section of the Civil Rights Division, United States Department of Justice, where he conceptualized and led the Combating Redlining Initiative until he retired in 2023. Government officials and members of the fair lending defense bar highly respect him. His experience has given him an expert perspective on redlining risk and achieving win-win solutions. In short, he is the perfect person to help you navigate redlining issues. Redlining risk is at an all-time high! In October 2021, the DOJ launched its Combating Redlining Initiative - the federal government's most aggressive and coordinated effort to combat redlining. Since launching this Initiative, the DOJ has resolved 13 cases with monetary relief exceeding $122 million. Since 2015, DOJ and CFPB have partnered on four redlining cases with relief exceeding $50 million and civil money penalties totaling $17.5 million. There is unprecedented coordination with the United States Attorney's Offices nationwide, with state attorneys general and other government agencies. Fair lending referrals to the DOJ from financial regulatory agencies have increased and will continue to grow. Private plaintiff attorneys have resolved redlining claims and sometimes filed lawsuits.

Here are my top 3 takeaways from an incredible start to the Wolters Kluwer's 2024 CRA & Fair Lending Colloquium! ? Yesterday, I had the privilege of crossing off a professional bucket list item, presenting on the national colloquium stage! ? I was honored to moderate a panel of absolute rock stars which made my job easy. ? A big thank you to Jon Seward, Varda Hussain, and Monica Palmeira for an incredible discussion! ? We explored the crucial topics of redlining and blue lining, initiating meaningful dialogue around equity and access. ? Here are my top three takeaways from our discussion: ? 1?? Blue lining: This occurs when areas affected by climate change are excluded from access to financial products like loans and insurance. These areas often overlap with low-income and predominantly communities of color, compounding inequities. ? 2?? Redlined communities: Despite historical challenges, these communities present incredible opportunities for growth, if lenders are willing to step up, invest, and truly put in the work. ? 3?? Combatting redlining initiatives: This important work is deeply entrenched in the efforts of state Attorneys General and federal agencies, making sure the work keeps moving forward through political changes. ? A heartfelt thank you to my panelists for an engaging and impactful conversation. ? The work we’re doing matters and I’m so inspired by everyone here committed to driving change. ? If you're at the colloquium, come say hi!? ? #fairlendingguru #cracolloquium ************************ My goal is to end discrimination in the banking industry.

The Justice Department and Consumer Financial Protection Bureau (CFPB) announced today that Fairway Independent Mortgage Corporation (Fairway) has agreed to pay $8 million and a $1.9 million civil money penalty to resolve allegations that it engaged in a pattern or practice of lending discrimination by redlining predominantly Black neighborhoods in and around Birmingham, Alabama. Redlining is an illegal practice by which lenders avoid providing credit services to individuals living in communities of color because of the race, color, or national origin of residents in those communities. With this settlement, the Justice Department’s Combating Redlining Initiative surpassed $150 million in relief for communities of color nationwide that have experienced lending discrimination. This settlement marks the Justice Department’s 15th redlining settlement in three years. Under the Combating Redlining Initiative, the Department has secured a historic amount of relief that is expected to generate over $1 billion in investment in communities of color in places such as Houston; Memphis; Los Angeles; Philadelphia; and Birmingham. “This settlement, and the over $150 million in relief the Justice Department has secured for communities across the country through our Combating Redlining Initiative, will help to ensure that future generations of Americans inherit a legacy of home ownership that they too often have been denied,” said Attorney General Merrick B. Garland. “This case is a reminder that redlining is not a relic of the past, and the Justice Department will continue to work urgently to combat lending discrimination wherever it arises and to secure relief for the communities harmed by it.” Read more: https://lnkd.in/g7yM9Z_h

With coordinated investigations on the rise, Win-Win Solutions is focused on providing fair lending training and risk assessments to transform growing risks into valuable opportunities. #FairLending #RiskMitigation #RiskTraining #RedliningAssessment #LendingInvestigation

One of the best parts of the CRA Hub ... When we have asked our most seasoned members what they find most valuable in the CRA Hub, we consistently heard "the guest speakers!". Two weeks ago, we enjoyed robust discussions about navigating fair lending and CRA challenges at Asurity's Fair Lending Forum. Founder and President, Jon Seward, emphasized the importance of taking proactive steps to mitigate risk. With redlining enforcement actions at an all-time high, there is no better time to assess your risk proactively. At Win-Win Solutions, we are committed to helping lenders transform that risk into profitable opportunities. #FairLending #CRA #Redlining #ProactiveSolutions #WinWinOpportuinities #AsurityConference
Continuing the CRA discussion. We have another view with "Special Topics in CRA" featuring Andy Sandler, Jesse Van Tol and Jon Seward. The discussion begins with the thought that both sides of the CRA debate have meaning and we should listen to what each sides concerns are, for instance the topic of overdraft fees. Where do you stand in the debate? #2024FLF #RiskExec
