We just received an NIW denial. The entire denial was based on a straw man argument where USCIS clearly misrepresented our claims. In the denial, USCIS said that our client’s proposed endeavor was to continue his role as a senior analyst at his company, and that this was in no way in the national interest. Even though we stated throughout our petition the many different ways that he’d be benefiting the U.S., describing his endeavor holistically because his endeavor is not tied to his specific role or his specific company. Just because your work impacts your field outside of your employer does not mean you meet the original contributions criterion. USCIS wants to see influence. Impact as well. What does profile building look like for EB-1A, NIW, and O-1A? It can look very similar. No matter how early you are starting, building your profile now can benefit you down the road. Activities that can help: ?? Board/Advisor Positions ?? Committee Positions ?? Awards ?? Authorship of Scholarly Articles ?? Authorship of Other Articles ?? Conference Speaker ?? Memberships ?? Judging Opportunities ?? Mentorship Gigs ?? Volunteering at Universities ?? Licenses ?? Certifications Each of these can be a piece of the puzzle. If you’re even just a few thousand dollars below the 90th percentile salary level for your Bureau of Labor Statistics occupation, You will have a difficult time claiming the EB-1A high salary criterion. Seems unreasonable but that is what I’ve seen in adjudications. It’s possible to get your company to increase your salary by a few thousand dollars so that you do meet the 90th percentile salary level for your occupation, but this seems to only work at smaller companies and not larger ones. Not all profile-building activities will lead to something you can mention in your EB-1A case. For example, joining IEEE is not something that will significantly help your case. That does not mean you should not do these activities. Because for the most part, you have to do these activities to get access to higher level activities like committee positions, speaking opportunities at top conferences, and even board positions. Start getting involved is what I tell most people who are just starting to build their profiles (especially junior and mid-level professionals who do not have a strong anchor criterion). Here’s how EB-2 NIW may change in the near future: — Professionals in certain fields will still be able to present strong cases, but the fields might narrow (healthcare, semiconductors, academia, etc.). — More RFEs across the board. — If you’re in tech and have a lot of experience and have made good contributions to the entire field/industry, then you could still get approved, but contributions will be much more important. Judging is one of those EB-1A criteria that is rarely questioned assuming you have sufficient evidence because: — There’s good federal court decisions around this criterion? (that helps applicants). — USCIS has to look at the plain language of the criterion and not introduce final merits into their evaluation of whether you’ve met the criterion. So if you’re building an EB-1A profile, definitely look into claiming judging.
