What's in store for cryptocurrency litigation following Donald Trump's election? Brian Klein told? The American Lawyer that?"[e]veryone is going to spend some time thinking through what this might mean for both current court cases and pending investigations." Klein explained:?"There are three months before Trump takes power and before he starts to fill in the people he wants to lead these agencies. But I expect less regulatory action than private litigation." #Crypto #Crytocurrency #Bitcoin #Digitalassets #Litigation #SEC

TD, the ninth largest bank in the United States and second largest in Canada, pleaded guilty to money-laundering conspiracy, settling for $3.09 billion with U.S. authorities last week, without anyone at the bank being charged. Brian Klein, who talked with American Banker about the case noted, "A small business engaging in similar misconduct like TD Bank would likely see its key individuals prosecuted, but the sheer scale of a large institution often shields the individuals within it." "Large institutions, like big banks, can often absorb fines without major impact," said Klein. "Whereas smaller businesses typically can't.” #banking #financialcrimes #whitecollar #whitecollarcrimes (subscription required)
