  • 🚨 Important FBI Alert: The Rise of Quit Claim Deed Fraud 🚨 Attention Property Owners and Real Estate Professionals: The FBI Boston Division is issuing a critical warning regarding an increase in quit claim deed fraud—a sophisticated scam targeting landowners and property investors alike. Fraudsters are using forged documents to illicitly transfer property ownership, resulting in significant financial loss and legal complications. What’s at Stake? Scammers are exploiting vulnerable properties, selling them, taking out loans, or even renting them, all without the knowledge or consent of the rightful owner. The consequences can be severe, leaving victims in costly and time-consuming legal battles to reclaim their property. Key Statistics From 2019 to 2023, real estate fraud resulted in $1.3 billion in reported losses nationwide. In the Boston region alone, 2,300 victims lost over $61 million. The true scale of the damage is likely even higher, as many victims are unaware or reluctant to report their losses. What You Can Do to Safeguard Your Interests For Landowners: - Set up property title alerts with your local registry of deeds (message me for more information on how to do this). - Regularly monitor online property records. - Take note of any unusual changes, such as missing utility or tax bills. - Arrange for periodic checks on vacant properties, either personally or through a property manager. For Real Estate Professionals: - Avoid remote closings and encourage in-person meetings when feasible. - Always verify the identity of clients through reliable methods, such as in-person checks and document verification. - Confirm all transaction details directly with the property owner, especially if they are unavailable for face-to-face communication.   • Founding Partner George Warshaw represented seller clients who fought for years over the enforceability of an offer. George handled the sales negotiations, while Attorney Robert Stetson represented them in litigation against the buyer. Bob secured an appellate victory that fundamentally changed the landscape of real estate law! In the McCarthy v. Young case, a standard Massachusetts Association of Realtors (MAR) form, commonly used in residential real estate, led to years of litigation—ultimately reshaping how attorneys and courts will approach offer forms going forward. This landmark case will have a lasting impact on all future real estate deals.   • Legal Update: CTA’s/BOI Filing’s Curtain Call?   Good news! In what we can only hope is the final chapter of the Corporate Transparency Act (CTA) saga, the Treasury Department has announced that it will not be issuing penalties or fines against U.S. citizens or domestic reporting companies for skipping out on filing Beneficial Ownership Information with FinCEN.   Instead, the Treasury is promising a new rule that will limit the CTA’s reach to foreign reporting companies only. We’re cautiously optimistic that this could be the end of the line for CTA in its current form.   We’ll keep an eye on this and let you know if anything else changes.     BREAKING NEWS: BOI REPORTS PUT ON HOLD AGAIN!   I feel like a weathervane, telling you one day you need to file your BOI reports, then the next that you don’t, then again that you do and now……   In an unexpected development, the Fifth Circuit Court of Appeals issued an order YESTERDAY, December 26th reinstating the nationwide preliminary injunction blocking the burdensome beneficial ownership information (BOI) reporting requirements. The Court is continuing its review of the appeal, which challenges the constitutionality of the CTA regulations. Oral arguments for the case are scheduled for March 25, 2025, meaning a final ruling may be months away.   The court’s reinstatement of the nationwide injunction offers much-needed relief. After being told earlier this week to urgently submit their BOI reports, businesses have faced significant chaos and confusion. Fortunately, the court's decision acknowledges the serious constitutional issues with the BOI reporting requirements.   Additionally, with the shift in control of Congress starting in January, there is a possibility that new legislation could be introduced to eliminate the CTA regulations altogether.   This is clearly a developing story that is changing day to day, but for the moment, you can hold off filing your BOI reports until and if the injunction is lifted.
