On October 22, 2024, the Securities and Exchange Commission (“SEC”) charged four technology companies with making inadequate disclosures related to the December 2020 discovery that SolarWinds Corp. had been a victim of a largescale cyberattack believed to have been conducted by state-sponsored Russian hackers.?According to the SEC’s October 22, 2024 press release, during 2020 and 2021, these four companies learned “that the threat actor likely behind the SolarWinds Orion hack had accessed their systems without authorization, but each negligently minimized its cybersecurity incident in its public disclosures.” [1]?The SEC’s cases, charging violations of Sections 17(a)(2) and 17(a)(3) of the Securities Act, Section 13(a) of the Exchange Act, and Rules 12b-20 and 13a-13 thereunder, are the first against users of the impacted SolarWinds product. ?They represent a somewhat controversial set of enforcement actions in the SEC’s rocky response to the SolarWinds hack.?

Walden Macht Haran & Williams LLP and Pollock | Cohen LLP File Class Action Lawsuit Against Anthem Blue Cross Blue Shield of New York Yesterday, WMHW and Pollock Cohen filed a class action lawsuit on behalf of thousands of patients against Anthem Blue Cross Blue Shield (BCBS) of New York. The lawsuit alleges the health insurance company perpetrated fraud by publishing an inaccurate directory of doctors who supposedly accepted BCBS insurance but, in fact, did not. These misleading directories – known as “ghost networks” – cause patients significant financial harm because patients in need of treatment must go to out-of-network to get care and incur substantial expenses. They also cause significant delays in people finding essential care and often abandoning care because they cannot find in-network doctors who actually accept the insurance. “People in desperate need of medical care are intentionally being misled by their insurance company,” said WMHW Partner Jake Gardener and co-counsel for the plaintiffs. “It costs these patients not just money but precious time to find necessary care. Legal Outreach Program Students Shine at Walden Macht Haran & Williams LLP Moot Court This past Tuesday, the WMHW Diversity & Inclusion Committee hosted a Moot Court Competition for high-school students from Legal Outreach, an educational program that provides academic support and professional opportunities to the youth from underserved neighborhoods in New York City.?Prepared by WMHW’s Amanda Senske and Angela Saidman, the 2024 Moot Court Competition involved an oral argument on a motion to suppress evidence in a criminal trial. The students played the roles of prosecutor and defense attorney, arguing whether or not certain evidence obtained by the police could be admitted at trial based on exceptions to the U.S. Constitution’s Fourth Amendment warrant requirement.?The students advanced compelling arguments and displayed their preparation and teamwork as they presented their arguments before WMHW partners Sean Haran and Milton Williams, who acted as mock judges. Congratulations to all our student participants and thank you to our attorney coaches Jeffrey Udell, Georgia Winston, John Curran, Veronica Maria W., Paul W.
