Clients regulated by, or who have contracts with government agencies regulated by, the National Environmental Policy Act (NEPA) should be aware of a major, recent court decision. On November 12, 2024, the D.C. Circuit Court decided Marin Audubon Society, et al., v. Federal Aviation Administration, et al. This decision held that the White House’s Council on Environmental Quality (CEQ) lacked rulemaking authority to issue regulations implementing the National Environmental Policy Act (NEPA). If the decision stands, it may stop or delay NEPA approvals for regulated projects. The 2-1 decision, which follows recent U.S. Supreme Court decisions weakening judicial deference to regulatory agency decisions, may be subject to review by the full D.C. Circuit and/or the U.S. Supreme Court. Because NEPA regulations impact a wide variety of projects and contracts, this is a significant decision. Read more here: https://ow.ly/77Ni50UbfG7

Today, the U.S. District Court for the Eastern District of Texas vacated the Department of Labor’s (DOL) final rule raising the salary thresholds for being exempt from overtime under the Fair Labor Standards Act (FLSA). The ruling applies nationwide and means that employers do not currently need to increase employee salaries in January 2025 to maintain their exempt status. It also vacates the July 1, 2024 increase. In 2018, as part of the “Trump tax cuts,” the federal estate, gift and generation-skipping transfer (GST) tax exemption was increased to $11,180,000, with annual increases for inflation. Today, the exemption stands at $13,610,000, and the exemption will increase to $13,990,000 on January 1, 2025. The Trump tax cut legislation provided that the increased exemption “sunsets” on December 31, 2025. At that time, the exemption will revert to what it would have been without the increase, which is estimated to be around $7,000,000, depending on inflation. Read more here: https://ow.ly/lVeY50U6u1h

We’re excited to welcome Zachary Mueck to the firm. He joined the firm recently as an associate in the Cincinnati office and a member of the firm's probate and tax group. He has experience in matters related to estate planning, estate administration, succession planning, corporate transactions, mergers and acquisitions, business formation and corporate structuring. Zach prepares and drafts a variety of documents for individuals with regards to estate planning, including revocable living trusts, irrevocable trusts, spousal lifetime access trusts, grantor-retained annuity trusts and special needs trusts. He also assists businesses and prepares and drafts documents for matters related to business formation, contracts and related transactional matters.
