"NABIP strongly supports a regulatory environment that ensures consumer access to high-quality, affordable healthcare coverage while preserving market stability. We believe the state and federal government can play a key role in the following areas, guided by the principles outlined in NABIP's Healthcare Bill of Rights, which advocates for choice, affordability, and access to trusted advisors: ?? Protecting Consumer Choice & Access to Agents – Government policies should ensure that consumers whether you are an individual, senior, employee, or employer—can work with licensed health insurance professionals who help them navigate complex coverage options and maximize their benefits. ?? Ensuring Transparency & Fair Competition – Regulators should hold all industry stakeholders including insurance carriers, pharmacy benefit managers (PBMs), and third-party administrators to the same level of transparency and accountability. This promotes cost efficiency, prevents hidden fees, and ensures that consumers and employers have clear, accurate information about their coverage. ?? Preserving Access to Employer-Sponsored Coverage – More than 150 million Americans rely on employer-sponsored health insurance, and it remains a crucial pillar of our healthcare system. Regulatory policies should support this market by encouraging flexibility and innovation in benefit design, including expanding the use of Health Savings Accounts (HSAs), Individual Coverage Health Reimbursement Arrangements (ICHRAs), and other tools that empower employers and employees to find the best coverage solutions. ?? Stabilizing the Market Through Thoughtful Regulation – While oversight is necessary, overly burdensome regulations can disrupt access to affordable coverage. NABIP advocates for policies that foster stability in the Medicare, employer-sponsored and individual health insurance markets, ensuring that consumers continue to have affordable and sustainable healthcare choices. ARE HOSPITAL/FIXED INDEMNITY AND CRITICAL ILLNESS PLANS SUBJECT TO COBRA? IT DEPENDS. The question of whether hospital indemnity, other fixed indemnity, and critical illness coverage seems to vex many. Some carriers go so far as offering their employer groups the option – provide COBRA coverage or not. The question is not that difficult: (1)???????Is the arrangement under which the hospital indemnity, other fixed indemnity, or critical illness coverage a “group health plan?” In many cases, it’s not. The IRS has long been of the view that these coverages provide “income replacement” and not “medical” coverage. Thus, at least for tax purposes, they provide disability insurance, not medical insurance. The point is made in a footnote in the preamble to a 2024 final “junk insurance” rule: “The original version of HIPAA that the House Ways & Means Committee referred to the House floor referred to hospital indemnity or other fixed indemnity insurance as a ‘‘hospital or fixed indemnity income-protection policy.’’ (Emphasis omitted). [89 Fed. Reg., p. 23,343, footnote 41]. COBRA applies to group health plans, not to disability coverage. There are instances, however, in which a hospital indemnity, other fixed indemnity, or critical illness coverage has so many “bells and whistles” that is crosses the line into providing medical coverage. (To get an idea of what these products designs might look like, please refer to IRS Private Letter Ruling 200704010 (https://lnkd.in/eYNCx4kH. While the ruling addresses what constitutes “permitted insurance” for purposes of Health Savings Account eligibility, it gets at a similar problem.) (2)???????Is the group premium less than the premium charged individuals in the retail market? In most cases, the premiums charged for hospital indemnity, other fixed indemnity, or critical illness coverage in the group market are discounted. (If not, the product is far less attractive.) Where the cost in the individual market is higher, then the arrangement is subject to COBRA. Of course, COBRA will only apply if the arrangement is a group health plan (see item (1) above). (3)???????Is the hospital indemnity, other fixed indemnity, and critical illness coverage being offered under a plan that satisfies the ERISA safe harbor for voluntary plans? Plans that satisfy the “voluntary plan safe harbor” are not subject to ERISA and not subject to COBRA as a result. The safe harbor requires that (i) the plan be entirely contributory (i.e., no employer money, and no cafeteria plan), (ii) participation be completely optional for employees, (iii) the employer not endorse that program, and (iv) the employer not receive any consideration in connection with the program. I have previously claimed that compliance with this safe harbor can be challenging, and employers might be better off not using it.?
