Many property managers assume their insurance would cover them in these scenarios, but that’s not always the case. Here are three real-world examples where gaps in E&O coverage could lead to a property manager paying a claim out of pocket: 1) A guest at a vacation rental falls through a damaged deck, claiming the management company failed to address the necessary repairs. 2) A tenant suffers severe property damage and injuries after an alleged delay in repair to a malfunctioning stove causes a fire. The tenant sues the property manager for alleged negligence in their professional services. 3) A tenant moves into a rental property and contracts a serious illness due to undisclosed mold. The claim alleges the property manager failed to detect or disclose the hazard. These types of lawsuits are called "Contingent Bodily Injury/Property Damage E&O Claims", and they're one of the top risks for property managers. General Liability policies are not designed to cover these E&O claims. The problem is that many property management E&O policies also *exclude* these E&O claims.
