    Last night, President Trump signed dozens of executive orders. What is an executive order, and which ones could potentially impact U.S. biofuels ???? ? An executive order is a directive from the President that manages federal government operations, using existing constitutional or statutory powers. It can set policies or direct agencies but cannot create or override laws. It’s common for new administrations to issue executive orders to quickly implement their priorities. Which ones could potentially impact U.S. biofuels? 1) Unleashing American Energy: President Trump’s executive order mandates an immediate review of agency actions that impose “undue burdens” on domestic energy, including biofuels. It also pauses IRA funding, with the intent of targeting "Green New Deal" funds such as EV subsidies. This could potentially impact 45Z claims temporarily, but overall, the order signals support for domestic biofuel production and associated credits. 2) Regulatory Freeze: President Trump’s Regulatory Freeze Pending Review executive order could potentially delay key rulemaking processes, including the final issuance of the proposed guidance for the 45Z clean fuel production tax credit, and stall other regulatory actions from the IRS and EPA. However, the Treasury Secretary and EPA Administrator nominees are already moving through the confirmation process, which could mitigate the impact of this freeze by accelerating the review and implementation of critical regulations once they are confirmed. The first 100 days of a Presidency tend to be the most important / impactful, so there should be many more executive orders and actions in the coming days ...     What is happening with biofuels in the U.S.? A recap of the MAJOR events from the past 2 weeks: 1) Internal Revenue Service released its long awaited 45Z CFPC Notice of Intent to Propose Regulation (Initial Guidance). As part of this, the government indicated the 45ZCF-GREET model will not include a pathway for imported Used Cooking Oil (UCO) until further guidance is issued on increased traceability requirements. 2) U.S. Department of Energy (DOE) issued the 45ZCF-GREET model. Indicative max credit values for domestic UCO range from $.60/gal (biodiesel) to $.63/gal (renewable diesel/HVO) to $1.10/gal (SAF). A transportation penalty was added to imported UCO (relative to domestic), suggesting that if/when imported UCO is permitted, it will be at a lower relative value. 3) USDA issued its Technical Guidelines for Climate-Smart Agriculture (CSA) Crops Used as Biofuels. The government dedicated an entire section of the Guidelines to chain of custody and verification, and another to recordkeeping and reporting standards. What's the major takeaway from all of this?     Treasury and IRS announce plan to issue further guidance on additional traceability requirements for imported UCO. Here's the full UCO language: "With respect to used cooking oil (UCO) feedstocks, the Treasury Department and the IRS are concerned about (1) the improper identification of a substance that is not UCO as UCO (for example, virgin palm oil mislabeled as UCO), which could have substantially greater emissions impacts than genuine UCO, and (2) the uncertainty of market impacts caused by incentivizing UCO (for example, the degree to which increased UCO demand would be backfilled by virgin oils such as palm oil). Both of these concerns are particularly acute for imported UCO given the lack of transparency regarding the local sources. Due to these significant concerns about the ability to reliably distinguish between imported UCO and palm oil, and the resulting risk of crediting ineligible fuels, the Treasury Department and the IRS are considering appropriate substantiation and recordkeeping requirements for imported UCO. As a result, pathways that use imported UCO will not be available in the 45ZCF-GREET model until the Treasury Department and the IRS publish further guidance. UCO is considered to be imported if it originates from a source (for example, restaurant or food processor) outside the United States and/or is purchased from an aggregator located outside the United States."
