Today we won an important victory for the 374-76 Prospect Park Tenants Association. In the 1980s, the City of New York placed them in its Tenant Interim Lease ("TIL") program, promising the tenants that if they were responsible stewards of the property, they could become its owners. They acted as the City's managing agent for the building, for no compensation, until June 2019, when the City announced that it was reneging on its promise. Today the Appellate Division: Second Judicial Department of the Supreme Court of the State of New York affirmed denial of the City's motion to dismiss the Tenants' causes of action for breach of contract, promissory estoppel, and breach of fiduciary duty. On #WorldAutismAwarenessDay, we highlight a significant issue spanning employment law and disability rights. Our client, a dedicated grocery store employee with autism, faced systemic discrimination and a lack of accommodations, essential for her to perform her job effectively and safely. Despite her courage in communicating her unique needs—such as the need for a quieter workspace and additional breaks for self-soothing—she was met with ridicule rather than support. From the outset, she navigated a workplace environment that was not only unsupportive but hostile. Her requests for reasonable adjustments, crucial for managing sensory overloads and ensuring her well-being, were consistently overlooked. This oversight extended to two separate store locations, where her pleas for empathy and understanding were answered with mockery and exclusion by both colleagues and management. Her condition was inappropriately discussed in public settings, further alienating her and exacerbating her distress. Such treatment not only contravenes the spirit of inclusivity and respect but also violates clear legal standards set forth by the Americans with Disabilities Act and Title VII of the Civil Rights Act of 1964. These laws mandate reasonable accommodations for employees with disabilities, aiming to provide them with equal opportunities in the workplace. Our firm stands with our client in seeking justice and advocating for a workplace culture that respects and accommodates the diverse needs of all employees, including those with autism.
