NEWS: The Southern District of New York preliminarily approved a $29.9 million settlement in a class-action lawsuit brought by FDNY Fire Protection Inspectors. The FPIs claimed that they were paid less than building inspectors who performed substantially similar work because the FPIs were primarily people of color. In contrast, the building inspectors have been mainly white.? ? Mehri & Skalet, PLLC, along with co-counsel Valli Kane & Vagnini, LLP, represented the FPIs. ? This was an atypical discrimination case in that the comparators – building inspectors – were employees in a different job title in a different department represented by a different union. This was also the first race discrimination case we are aware of in which class members included both white employees and people of color. This settlement will benefit nearly 600 current and former FDNY employees. The average award, even after payment of attorneys’ fees and service awards, is estimated to be between $35,000 and $40,000. ?
