??Lender Question Series ?? We are kicking off a new series to answer common questions from construction lenders! Here’s one we recently received: Question: "When a building permit is approved, can I assume that geotechnical reports and utility availability have been considered by the municipality? I'd like to streamline the documents we require for smaller projects." Answer: Permit requirements can vary widely by jurisdiction, but here’s a general breakdown: Geotechnical Reports: In my experience, geotechnical reports are usually not required for permit applications on smaller projects. Some jurisdictions may require them for larger developments, but for renovations, tenant improvements (TI), or small additions, these reports are typically unnecessary. However, without a report, there is a risk that unknown soil conditions near existing structures could require extra foundation work, impacting the budget. Utility Availability Letters: Similar to geotechnical reports, utility availability letters are generally not a permitting requirement. Typically, utility plans need approval from local water or sewer authorities before installation, but jurisdictions rarely require a formal letter confirming utility capacity at the permit stage. Smaller renovations often carry minimal utility risks, but ground-up construction—even on smaller projects—might require some due diligence. Zoning: When a building permit is issued, it’s usually a good sign that zoning has been reviewed and approved by the municipality. Additional zoning letters are rarely necessary once a permit is in hand, although a permit application alone (without approval) wouldn’t confirm zoning compliance. Conclusion: An approved permit offers a level of assurance, but for construction lenders, confirming certain details directly with the jurisdiction can help mitigate risk on smaller projects. ?? Highlights from the Effective Construction Monitoring Session at NAGGL Las Vegas! ?? Just wrapped up an insightful Q&A session on keeping construction loans on track. Here are some of the hot topics we tackled: 1?? How much $$ should trigger an inspection request? The consensus was that if ?? is being drawn for, then an inspection should requested. 2?? How should we handle Contractors asking for upfront funds? This can be a red flag for cash flow issues. Make sure to ask for financials, tax returns, and references. And if you do pay upfront, send it straight to the subcontractors or vendors. ??? 3?? Building without permits = big trouble! If the project gets shut down, lawsuits are likely. Lenders, always collect permits and plans before releasing funds. No permits, no money. ?? 4?? Can Permits be part of the construction loan? Yep, but get a letter from the city confirming plans have been approved. This keeps everyone in the clear! ?? 5?? Are there tips to streamline small TI projects (under $250K): Yes! Landlords can contribute by signing a tri-party agreement outlining how funds will be used. Make sure the landlord’s money goes in first before bank funds. ?? 6?? Should we get financials for smaller projects? For loans under $1M, financials aren’t typically needed. ?? Vet Contractors Thoroughly Select licensed and experienced contractors with a proven track record. Due diligence is key to quality. ?? Clear Contracts and Regular Inspections Draft comprehensive contracts that outline the scope of work and quality standards. Include provisions for inspections to catch issues early.
